网络环境下著作权限制制度研究

【摘要】：著作权法的基本精神就是通过赋予作者或者其他著作权人对其作品的专有权利而鼓励作品的创作与传播，从而促进科学、文化和艺术事业的发展和进步。著作权限制制度符合著作权法的基本精神，并且是实现著作权法立法目的的重要工具之一，因此有其存在的必要性。在传统环境下，著作权限制制度的设计尚且不存在偌大争议，但是随着网络环境的出现及发展，一方面促进了传统环境下的著作权法的发展，另一方面也给传统著作权法的发展带来了严峻的挑战，因此著作权限制制度也不可避免的面临一系列的挑战，如著作权限制制度是否应当继续存在，著作权限制制度的范围是应当扩大还是缩小等等。本文的研究对象是狭义的著作权限制制度，即强制许可制度、合理使用制度和法定许可制度。本文从分析传统环境下著作权限制制度的正当性着手，然后结合网络环境下著作权的新特征，进一步证明网络环境下著作权限制制度存在的必要性。传统环境下的著作权限制制度并不能够直接适用于网络环境下，，虽然我国的著作权法已经为应对网络环境的出现和发展作出了相应的修改，但是仍存在很多的不足之处，所以本文通过分析网络环境下的具体的著作权限制制度，然后通过借鉴国外的立法经验，并根据我国的国情，提出了进一步完善我国的著作权限制制度的建议。全文分为四章，第一章介绍了传统环境下著作权限制的基本理论以及网络环境给著作权保护带来的新问题，引出文章的主题；第二章介绍了当前国内外有关网络环境下著作权限制的规定；第三章分析了当前我国著作权限制制度所面临的困境，主要是从合理使用制度和法定许可制度两个方面进行分析；第四章是在第三章分析的基础上，提出完善网络环境下著作权限制制度的建议。
[Abstract]:The basic spirit of copyright law is to encourage the creation and dissemination of works by endowing the author or other copyright owners with the exclusive right to their works, thereby promoting the development and progress of science, culture and art. The system of copyright restriction accords with the basic spirit of copyright law and is one of the important tools to realize the legislative purpose of copyright law, so it is necessary to exist. In the traditional environment, the design of copyright restriction system is not so controversial, but with the emergence and development of the network environment, on the one hand, it promotes the development of copyright law under the traditional environment. On the other hand, it also brings severe challenges to the development of traditional copyright law. Therefore, the copyright restriction system inevitably faces a series of challenges, such as whether the copyright restriction system should continue to exist. The scope of copyright restriction system should be expanded or narrowed and so on. The research object of this paper is the narrow copyright restriction system, that is, the compulsory license system, the rational use system and the legal license system. This paper begins with the analysis of the legitimacy of the copyright restriction system under the traditional environment, and then combines the new features of the copyright under the network environment to further prove the necessity of the existence of the copyright restriction system in the network environment. The copyright restriction system under the traditional environment can not be directly applied to the network environment. Although the copyright law of our country has made corresponding modifications to cope with the emergence and development of the network environment, there are still many deficiencies. So this paper analyzes the specific copyright restriction system under the network environment, and then through the experience of foreign legislation, and according to the situation of our country, puts forward some suggestions to further improve the copyright restriction system in our country. This paper is divided into four chapters. The first chapter introduces the basic theory of copyright restriction under the traditional environment and the new problems brought about by the network environment to copyright protection, leading to the theme of the article; The second chapter introduces the current domestic and international regulations on copyright restriction under the network environment, the third chapter analyzes the difficulties faced by the current copyright restriction system in China, mainly from the two aspects of rational use system and legal license system. The fourth chapter is based on the analysis of the third chapter, put forward some suggestions to perfect the copyright restriction system under the network environment.
