基层领导干部作为懈怠现象的生成逻辑及其问责

【摘要】：基层领导干部作为懈怠是指基层领导干部负有积极履行岗位职责的义务,且客观上具备能够作为的条件,但在过程及其结果上呈现为不作为或不充分作为的现象。基层领导干部作为懈怠具有行为违法性、现象隐蔽性和结果消极性等特征,并可划分为慵懒无为、推诿延误、消极避事等类型。当代中国基层领导干部作为懈怠现象的生成逻辑,可以从观念、体制和环境三个层面切入,包括领导干部权力观异化、管理体制缺陷和监督问责机制处置乏力以及高压反腐背景等因素。对基层领导干部作为懈怠施以刚性约束的问责处罚,应具备的构成要件为:有具体有为要求的岗位职责、有怠于履行岗位职责的行为事实和造成一定危害后果的社会影响等。

As a result of slacking, the grass-roots leading cadres have the characteristics of illegal behavior, hidden phenomenon and negative result, and can be divided into idleness and procrastination, which can be divided into idleness and procrastination. As the formation logic of slack phenomenon, the leading cadres at the grass-roots level in contemporary China can be cut into the following three aspects: concept, system and environment, including the dissimilation of leading cadres' view of power.
