党内法规体系建设的法治路径

【摘要】：党内法规体系建设是规范党内权力制度化、规范化的根本举措,关乎国家治理体系和治理能力的现代化。党内法规存在着内容庞杂、体系分散、板块不全等问题,同时,党内法规与国家法律之间存在高度契合点,在国家治理方面可以实现良好的相互补充。因此,需要从法学视角去探寻党的建设中的法治规律,即以宪法思维作为总体指导思想,在制度设计中保持与其他法律规范内容上的协调和党内法规内部的协调,确保体系的完备和执行力,以权利义务为内容,兼顾党内法规的一般性和特殊性、制定程序上的科学性,用备案等制度完善法规制定程序,寻找党内法律与国家法律的契合之处,加强党内法规的硬性约束力。
[Abstract]:The construction of inner-party laws and regulations system is the fundamental measure to standardize the inner-party power institutionalization and standardization, which is related to the modernization of the national governance system and governance ability. There are many problems in inner-party laws and regulations, such as heavy contents, scattered systems, incomplete plates, and so on. At the same time, there is a high degree of agreement between inner-party laws and national laws, which can complement each other well in the aspect of national governance. Therefore, it is necessary to explore the rule of law in the construction of the Party from the perspective of law, that is, to take the constitutional thinking as the overall guiding ideology, to maintain the coordination with the contents of other laws and regulations and the internal coordination of the laws and regulations within the Party in the design of the system. To ensure the completeness and execution of the system, to take the rights and obligations as the content, to take into account the generality and particularity of the laws and regulations within the Party, to formulate the scientific nature of the procedures, and to perfect the procedures for the formulation of laws and regulations by means of systems such as Find out the conformity of inner-party law and national law, and strengthen the rigid binding force of inner-party law.
