【摘要】：正西方德性法理学的思想萌芽可以追溯至古希腊的亚里士多德的伦理学、政治学及其自然法本质的构想中。但是,当代西方的德性法理学作为一种规范和解释的法律理论,直接受到了当代西方德性伦理学复兴所提供的思想资源的启发。它融合德性伦理学、德性认识论和德性政治学,力图对当代法律理论的重大问题作出更深刻的回答,在亚洲、欧洲和北美引起了哲学和法学研究的关注。美国乔治敦大学法学院(Georgetown University Law Center)教授索伦(L B.Solum)是当代西方德性法理学研究
[Abstract]:The sprout of moral jurisprudence in the West can be traced back to the idea of Aristotle's ethics, politics and the nature of natural law in ancient Greece. As a kind of normative and interpretive legal theory, the contemporary western moral jurisprudence is inspired by the ideological resources provided by the revival of the contemporary western virtue ethics. Virtue epistemology and virtue politics try to give a more profound answer to the major questions of contemporary legal theory in Asia.
