【摘要】：本文拟以犯罪本源理论为基础,对犯罪控制进行解释。犯罪本源理论作为犯罪学研究领域中的基础理论,对犯罪学应用理论的研究有着很大价值。现代西方犯罪学一般不对此进行专门研究,但其诸多理论的提出都源于对犯罪本源的深刻领悟。国内犯罪学领域对此的研究盛行于20世纪80年代末90年代初,提出了诸多观点。本文拟用其中一种较有说服力的观点,即本能与文明冲突的犯罪本源观对犯罪控制的相关问题进行阐释。 文章内容分为三大部分:第一部分是前言,该部分主要作为写作本文的初衷以及思路进行大致的梳理,目的在于为正文的写作作铺垫。第二部分是正文,包括三章内容。第一章是犯罪本源理论,探讨犯罪本源理论的研究现状,重点论述其中作为本文解释工具的本能—文明模式。第二章是与犯罪本源相关的犯罪学理论,在梳理现有犯罪学理论基础上,对相关理论作犯罪本源观的解释,目的在于说明国内外诸多的犯罪学理论的提出与应用都是建立在犯罪本源基础之上的,从而为后文的犯罪控制寻求应然路径。第三章是犯罪本源理论在犯罪控制中的应用,首先简析犯罪本源理论与犯罪控制理论的关系,其次是犯罪本源观对当前社会本位的犯罪控制的检验,目的在于为犯罪控制寻求犯罪本源观的解释视角,在对现有的犯罪控制路径进行检验的同时,为今后的犯罪控制的途径选择提供启发。并强调个人本位的犯罪控制手段在犯罪防控中的作用,这也是本文写作的落脚点。最后一部分是结语,主要是对本文内容的总结以及本人的一些写作感想。
[Abstract]:This paper is based on the theory of the origin of crime, to explain the origin of crime. The crime control theory as the basic theory of criminology research, it has great value for research and application of theory of criminology. Modern western criminology is generally not the specialized research, but the various theories are derived from the deep understanding of the origin of the crime the domestic study on this field of criminology. Popular in late 1980s and early 90s, put forward a number of views. This paper is intended to use a more persuasive argument, namely instinct and civilization conflict crime original concept and explain the relevant problems of crime control.
The article is divided into three parts: the first part is the preface, the main part is the original intention of writing this article and the idea of comb is to pave the way for the writing of the text. The second part is the main body, including three chapters. The first chapter is the origin of the crime theory, research status for crime origin theory, focuses on as this article explains tool instinct and civilization mode. The second chapter is the theory of Criminology and crime related to the origin, in the existing criminology theory based on the concept of interpretation of criminal origin theory, the purpose is to explain the theory of Criminology at home and abroad many proposed and applications are built on the basis of the origin of crime, and after the crime control should seek path. The third chapter is the application of criminal theory in the origin of crime control, the first analysis of the origin theory of crime and crime control The second is to test the theory, the original concept of crime control crime on the current social standard, the purpose is to seek explanation for the original concept of crime crime control, in the existing criminal control path test at the same time, choose to provide inspiration for the future path of crime control and crime control. That means the individual standard in the crime prevention and control, which is the author's purpose. The last part is the conclusion, is a summary of this paper and writing some of my feelings.
