【摘要】：在本案中,邱兴华作案的动机令人无法理解,手段残忍的程度也完全超出正常人的理解范围。部分精神医学专家根据律师调查的情况和有关证人的证词,怀疑邱兴华患有精神疾病。随后,多名法学家、律师也发表公开信或谈话,主张对邱兴华进行精神鉴定的问题。而二审法院却最终驳回辩护人要求精神鉴定的申请,对邱兴华判处死刑。这使得社会对精神障碍的刑事责任能力问题的关注达到了顶点。文章在第一章简要介绍了本案的基本情况以及案件的争议焦点；在第二章和第三章则主要围绕着案件的争议焦点来展开分析；在第四章主要论述了笔者对此案件的一些反思。本文采用以案例分析方法为主、论述方法为辅的综合性论述方法,从法学、辩证法的角度出发,提出课题研究的背景,阐述课题研究的价值,分析存在的相关问题,以及解决问题的方法和途径这一逻辑思维脉络,运用理论联系实践的方法进行写作。笔者将围绕着所选案例的争议焦点,即精神障碍者的刑事责任能力问题和本案中所反映的我国司法鉴定制度存在的问题,最后阐述了对我国的司法鉴定制度的建言,以其可以对我国关于精神障碍者责任能力问题的研究和我国精神司法鉴定的完善有所裨益。
[Abstract]:In this case, Qiu Xinghua is unable to understand the motive, means cruelty is completely beyond the scope of normal human understanding. Part of the spirit of medical experts according to the investigation of the case and the relevant lawyer witness, Qiu Xinghua suspected of suffering from mental illness. Subsequently, many jurists, lawyers also published an open letter or talk, advocating the spirit of the identification of Qiu Xinghua's problems. But the court of second instance but ultimately rejected the defense request for psychiatric evaluation, the death penalty for Qiu Xinghua. This makes the social problem of criminal responsibility of mental disorder, attention to the climax.
In the first chapter, the basic situation of the case and the controversial focus of the case are briefly introduced. In the second and third chapters, the focus of the dispute is analyzed. In the fourth chapter, I mainly discuss some reflections on the case.
This paper mainly adopts the methods of case analysis, a comprehensive discussion of methods, discusses the method from the law, dialectical point of view, put forward the research background, expounds the value of the topic, related problems were analyzed, and the method and the way to solve the problem of the logical thought, using the method of theory and practice writing.
The author will focus on the selected cases are the focus of controversy, the judicial system in China the problems that problem of criminal responsibility of persons with mental disorders and in this case, finally elaborated the judicial appraisal system in our country's suggestions, in order to perfect its to research on ability of mental disorders responsibility I China and the spirit of our judicial benefit.
