【摘要】：我国近些年来持续的开展的“打黑除恶”行动,打掉了一部分的黑社会性质组织,有利于保护人民的正常生活,维护社会的正常秩序。但是也让我们认识到了黑社会性质组织的发展速度,因其一些现象特性而警惕。“打黑除恶”一直作为一项专项斗争而进行,一定程度上扼制了黑社会性质组织的发展,但是另一方面这项斗争是一种刑事手段的存在而并非作为长期而持久、详细的列于刑事法律的进程中,其所要求的是在特定时间内达到一定的结果,这样导致的结果是“打则消,不打则涨”,为了保证“打黑除恶”专项斗争的效果得以延续,必须建立长效机制。本文总共分为三章对此进行论述,第一章为黑社会(性质)组织的概述,第一节简要分析域外地区,如日本、意大利、台湾等地黑社会的现状,以及域外打击黑社会行动的特点,因域外黑社会的形成和发展都久于我国,其打击黑社会的经验也较丰富具有值得我国借鉴之处;第二节以数据结合典型案例的方式分析我国当前黑社会性质组织具有犯罪种类多样化、分布范围广、寻求“保护伞”、再生能力快等特点,黑社会性质组织产生、发展都有一定的规律可循,我国黑社会性质组织的特点决定了我国“打黑除恶”的手段。第二章通过文献资料分析的方法,分析我国“打黑除恶”专项斗争的开展,全国范围内1983年至1986年,1996年至1997年,以及2000年以后的三次“打黑”斗争和效果,以及具有特性的一些省市如广东、重庆等地“打黑”斗争的开展特点及效果。第三章从建立长效机制角度,分析延续我国“打黑除恶”斗争效果的办法,刑事立法方面结合《刑法修正案⺌八⺗》分析如何加大对黑社会性质组织犯罪的惩处力度,司法方面注意兼顾被告人和被害人两方面的权益。

The second chapter through the analysis of the literature data, analysis of the special struggle in China "crime crackdown" carried out nationwide from 1983 to 1986, From 1996 to 1997, and after 2000 three "anti" struggle and effect, and has the characteristics of some provinces and cities such as Guangdong, Chongqing and other places to carry out the fight "anti" characteristics and effect.
