脑死亡与器官移植法律问题研究

【摘要】：随着医学科技的发展,人们对死亡有了全新的认识,在医学界,死亡标准从传统的心死亡逐渐过渡到现代的脑死亡,随之而来的需要法律制度的革新。器官移植有着悠久的历史,但直到最近几十年,才在技术上真正有所突破,并广泛地运用于终末期器官衰竭的病症治疗中,随之而来同样需要法律制度的变革。脑死亡与器官移植紧密相连,又有区别,本文主要研究脑死亡与器官移植的相关法律制度。第一章主要阐述了脑死亡和器官移植的基本概念,先对死亡进行了概述,然后阐述了心死亡和脑死亡的概念及新旧死亡的判定标准,最后阐述了器官移植的概念、种类及发展历史。第二章主要是对脑死亡和器官移植所涉及的基本法律问题的研究。具体讨论了脑死亡法和器官移植法的关系,脑死亡法和器官移植法的制定意义,脑死亡法和器官移植法的特征,并对死亡标准的确立、供体提供器官、受体接受器官进行了法理分析,以期阐明其制度构建的法理基础。第三章主要是对脑死亡和器官移植法律制度的构建中的论争和冲突进行研究。具体讨论了立法时对一元死亡标准及二元死亡标准选取的论争,分析了脑死亡和器官移植法律制度如何进行价值选取,阐述了脑死亡和器官移植的立法模式,以期对我国脑死亡和器官移植法律制度的构建提供参考。第四章主要是对我国现行脑死亡和器官移植法律制度进行研究。具体阐述了我国脑死亡和器官移植法律制度的立法现状,提出了现行立法的不足,并从宏观上提出了构建我国脑死亡和器官移植法律制度的构想,以期为我国脑死亡与器官移植立法贡献绵薄之力。
[Abstract]:With the development of medical science and technology, people have a new understanding of death, in the medical world, the standard of death gradually transition from traditional heart death to modern brain death. Organ transplantation has a long history, but only in recent decades has a real breakthrough in technology, and widely used in the treatment of end-stage organ failure. Brain death and organ transplantation are closely linked and different. This paper mainly studies the related legal system of brain death and organ transplantation. The first chapter mainly describes the basic concepts of brain death and organ transplantation. Then the concepts of heart death and brain death and the criteria of new and old death are expounded. Finally, the concept, types and development history of organ transplantation are expounded. The second chapter is mainly about the basic legal issues of brain death and organ transplantation. It discusses the relationship between brain death and organ transplantation, the significance of brain death and organ transplantation. The characteristics of brain death method and organ transplantation method are analyzed in order to clarify the legal basis of the establishment of the death standard, the provision of organs by donors and the recipient organs in order to elucidate the legal basis of the system construction. The third chapter is mainly about the controversy and conflict in the construction of the legal system of brain death and organ transplantation. This paper analyzes on how to select the value of the legal system of brain death and organ transplantation and expounds the legislative model of brain death and organ transplantation in order to provide reference for the construction of the legal system of brain death and organ transplantation in China. Chapter 4th mainly focuses on the current legal system of brain death and organ transplantation in China. It expounds the current legislative situation of the legal system of brain death and organ transplantation and puts forward the deficiency of the current legislation. It also puts forward the conception of constructing the legal system of brain death and organ transplantation in order to contribute a little to the legislation of brain death and organ transplantation in China.
