【摘要】：随着近年来我国反腐实务工作的深入开展，犯罪学界对职务犯罪这一犯罪类型的理论探究也呈现出不断创新、一片繁荣的景象，其中一个明显的趋势便是不再拘泥于笼统讨论职务犯罪，而是对不同专业领域出现的职务犯罪现象的不同成因和特点展开“分块状”的，亦即“领域型”的研究。当前金融业界频发的职务犯罪吸引了各界的注视目光，造成了极坏的社会影响。对此，本人将研究对象锁定为金融领域职务犯罪，希图厘清其状貌，把准其“来龙”，，并就如何截住其“去脉”提供一定的建议。本文第一章，笔者对金融领域职务犯罪概念、分类以及现状进行了简要介绍分析；第二章，在第一章的基础上，笔者论述了当前我国金融领域职务犯罪的六大突出特点；第三章，笔者点明了金融领域职务犯罪对我国国计民生的严重危害；第四章，笔者从犯罪学、犯罪心理学、经济学这几个学科角度分析了金融领域职务犯罪的成因，其中在每一个学科分析中又用到了多种理论解释；在文章的最后一部分中，笔者从深化金融体制改革、压缩权力寻租空间，强化操作风险管理、培育行业合规文化，加大社会控制力度、提高职务犯罪成本，关注员工身心状况、及时化解工作压力等角度提出了对金融领域职务犯罪的防控意见。
[Abstract]:With the development of anti-corruption practice in China in recent years, the theoretical research on the crime type of job-related crime in the field of crime also presents a scene of innovation and prosperity. One of the obvious trends is no longer confined to the general discussion of job-related crime, but to the different causes and characteristics of the phenomenon of job-related crime in different professional areas "divided into blocks". In other words, the research of "domain type". At present, the frequent occurrence of job-related crimes in the financial industry has attracted the attention of all circles and caused a very bad social impact. In view of this, I will focus my research on the job-related crimes in the financial field. Hope to clarify its appearance, the accurate "Lilong", and how to intercept its "pulse" to provide some advice. The first chapter of this article, the author of the financial field of the concept of job-related crime. The classification and current situation are briefly introduced and analyzed. The second chapter, on the basis of the first chapter, the author discusses the current financial field of the six prominent characteristics of crime; In the third chapter, the author points out the serious harm to the national economy and the people's livelihood caused by the job-related crime in the financial field. In Chapter 4th, the author analyzes the causes of job-related crime in the financial field from the perspective of criminology, criminal psychology and economics, in which a variety of theoretical explanations are used in the analysis of each subject. In the last part of the article, the author deepens the financial system reform, compresses the power rent-seeking space, strengthens the operation risk management, cultivates the industry compliance culture, strengthens the social control dynamics, raises the duty crime cost. The author puts forward the prevention and control opinions on the position crime in the financial field from the angle of paying attention to the mental and physical condition of the staff and resolving the working pressure in time.
