农村大学毕业生户籍流转问题的调查报告

【摘要】：我国目前采用的是1958年全国人大常委会通过的《中华人民共和国户口管理条例》,形成了农村户口和城市户口“二元结构”的户籍管理体制。此管理制度曾在国家社会管理中起到了不可替代的作用,但是随着发展,以供应城镇居民定量粮为标准划分农业户口与非农业户口的做法,既不科学也不合理。附加在户口上的各种利益,成为实现公民平等权的一大障碍,也难以与构建和谐社会的时代之音产生共鸣。农村大学毕业生是现行户籍管理制度下的一类特殊群体,他们之前是农业户口,由于升学转为非农业户口,但大学学历并不必然保证他们能取得城市户口并享有城市户口带来的利益,“非农”的身份甚至将其原先集体所有制下的权利也剥夺无遗。本文通过以安徽省金安区2009年农村大学毕业生户籍流转情况为样本的调查,分析探讨其中涉及的法律问题。本篇论文分为四个部分：第一部分：调查活动概述及调查结果分析。笔者在此部分就调查目的、调查时间、调查地点、调查对象、调查方法以及问卷回收等基本情况作了简要交待,并对调查结果进行分析。第二部分：我国户籍管理体制概述。此部分针对户籍管理的目的,户籍管理的历史渊源以及我国现行户籍管理体制作了概括介绍。并以此为切入点为下文的户籍流转所涉及问题的法律分析做出必要准备。第三部分：农村大学毕业生户籍问题法律分析。此部分是文章的重点所在,笔者分析了现今附加在户口之上的各种利益,对农村大学毕业生的身份、处境作简要分析,并讨论现行户籍制度对这一群体的就业产生的不利影响。第四部分：农村大学毕业生户籍流转的法律规制探讨。建立在调查结论、原因分析的基础上,结合现阶段国情现行制度,笔者针对如何降低户籍对农村大学毕业生的不利影响提出建议,以期对我国户籍制度的发展完善有所贡献。
[Abstract]:At present, China adopts the regulations of the people's Republic of China on hukou Administration, adopted by the standing Committee of the National people's Congress on 1958. The household registration management system has formed the "dual structure" of rural and urban hukou. This management system has played an irreplaceable role in the national social management, but with the development. It is neither scientific nor reasonable to divide agricultural hukou and non-agricultural hukou according to the standard of supplying ration grain to urban residents. All kinds of benefits attached to hukou have become a big obstacle to realize the equal rights of citizens. It is also difficult to resonate with the voice of the times in building a harmonious society. Rural university graduates are a special group under the current household registration management system. They were formerly agricultural hukou, but they have been transferred to non-agricultural hukou as a result of their further studies. But college degrees do not necessarily guarantee them access to urban hukou and the benefits of urban hukou. The status of "non-agricultural" even deprived its rights under collective ownership. Based on the investigation of rural university graduates' household registration circulation in 2009 in Jin'an District of Anhui Province. The legal problems involved are analyzed and discussed. This paper is divided into four parts: The first part: the summary of investigation activities and the analysis of the survey results. In this part, the author gives a brief account of the purpose, time, location, object, method and recovery of the questionnaire. The results of the investigation were analyzed. Part two: summary of household registration management system in China. This part aims at the purpose of household registration management. The historical origin of household registration management and the current household registration management system in China are introduced briefly, and the necessary preparation for the legal analysis of the problems involved in the following household registration circulation is made. The third part: rural university graduate household registration legal analysis. This part is the focus of the article, the author analyzes the current attached to the various interests of the household registration, to the status of rural university graduates. This paper briefly analyzes the situation and discusses the adverse effects of the current household registration system on the employment of this group. Part 4th: discussion on the legal regulation of household registration transfer of rural university graduates. Based on the conclusion of the investigation and the analysis of the reasons, combined with the present situation of the current system. The author puts forward some suggestions on how to reduce the adverse effects of household registration on rural university graduates in order to contribute to the development and perfection of the household registration system in China.
