上海合作组织框架下中亚恐怖主义犯罪研究

【摘要】： 恐怖主义犯罪由来已久,特别是在20世纪60年代以后,逐渐发展为一个全球性的难题,已经成为威胁人类生存与安全的重要内容。中亚恐怖主义犯罪日益猖獗,对中亚各国的和平、安全与稳定构成严重威胁。在此情形下,上海合作组织在打击中亚恐怖主义犯罪方面发挥了非常重要的作用。我国作为成员国之一,如何在打击恐怖主义犯罪方面完善刑事立法,同时如何针对上海合作组织存在的不足,完善上海合作组织的反恐职能,对预防和打击中亚恐怖主义犯罪有非常重要的意义。本文首先介绍了恐怖主义犯罪的一般理论,其次阐述了中亚的恐怖组织、恐怖主义犯罪的现状与特点及中亚国家打击恐怖主义犯罪的立法与实践。在此基础上,论述我国打击恐怖主义犯罪的立法、存在的问题以及如何完善。最后阐述上海合作组织在打击中亚恐怖主义犯罪方面的对策、不足,并提出完善建议。
[Abstract]:The crime of terrorism has a long history, especially after 1960s, it has gradually developed into a global problem. It has become an important content that threatens the survival and security of mankind. The crime of terrorism in Central Asia is rampant day by day, which poses a serious threat to the peace, security and stability of the Central Asian countries. Shanghai Cooperation Organization (SCO) has played a very important role in cracking down on the crime of terrorism in Central Asia. At the same time, it is of great significance to prevent and combat the crime of terrorism in Central Asia by improving the anti-terrorism function of the Shanghai Cooperation Organization. This paper first introduces the general theory of terrorist crime, and then expounds the terrorist organizations in Central Asia. The present situation and characteristics of terrorist crime and the legislation and practice of combating terrorist crime in Central Asian countries. On this basis, this paper discusses the legislation of combating terrorist crime in our country. Finally, the countermeasures and shortcomings of Shanghai Cooperation Organization in the fight against terrorism in Central Asia are expounded, and some suggestions are put forward.
