【摘要】： 近年来,商业贿赂犯罪形势十分严峻,商业贿赂犯罪活动几乎渗透到各种经济领域中,每年因商业贿赂而造成国家和社会财富的流失难以统计。与此同时,自2002年《外商投资建筑业企业管理规定》开始实施后,外商可以在华成立独资建筑企业,这表明我国建筑市场已基本完全向外资放开,将使外资在更大规模上参与国内建筑市场的竞争,使得商业贿赂犯罪呈现跨国(边)界的趋势,这给我国司法机关打击商业贿赂犯罪的工作增添了不少挑战。在这种背景下,胡锦涛总书记在党的十七大报告中明确提出要着力加强反腐倡廉建设,强调“全党同志一定要充分认识反腐败斗争的长期性、复杂性、艰巨性,把反腐倡廉建设放在更加突出的位置,旗帜鲜明地反对腐败”。商业贿赂是指商业行为主体在商业过程中,为谋取商业利益而故意采取各种贿赂手段侵害正常市场秩序的行为。建筑领域商业贿赂是整个商业领域贿赂犯罪的一个重要组成部分,顾名思义,它是指发生在建筑领域的权力与相关利益的交易行为。建筑领域商业贿赂给中国经济带来了很大的危害,它就像一种病毒,破坏社会主义市场经济秩序,败坏政风和社会风气,滋生腐败行为和经济犯罪,已成为经济社会生活中的一大公害。因此,加强对建筑领域商业贿赂行为的研究,并在此基础上,采取具有针对性的侦查措施,建立健全打击建筑领域商业贿赂犯罪的长效机制,对于营造良好的商业环境,推动我国社会主义市场经济的健康发展有着重要的理论意义和实践意义。这也是本文研究的目的和意义所在。本文的写作在参考了大量具有前沿性、代表性的优秀文献和报刊资料的基础上,运用了比较、历史、逻辑求证等研究方法,同时针对侦查学研究方法的特殊性,为了增强文章的说服力,特别强调了案例实证的方法,文中许多地方在说理之后尽可能多地附加最近几年发生的案例予以证明,力求以最新、最具说服力的客观事实来证明笔者观点。本文共分三个部分,约三万二千字。第一部分是关于建筑领域商业贿赂的情况概述。这部分简要地阐述了商业贿赂行为的概念以及建筑领域商业贿赂的概念内涵等,重点明确了建筑领域商业贿赂行为发生的部位;介绍了打击建筑领域商业贿赂的政策及其背景,并着重分析建筑领域商业贿赂犯罪的案件特点,这为后文研究犯罪分子的作案手段和侦查对策提供了坚实的基础;最后提出建筑领域商业贿赂犯罪的危害,为文章写作指向了研究方向。第二部分是关于建筑领域商业贿赂犯罪的行为模式。研究贿赂犯罪的行为模式能对于侦查破案、对犯罪进行防范控制等具有重大意义。文中将行为模式内容按照特定的逻辑结构进行组文,把从犯罪分子的犯罪成因到如何实施犯罪以及实施犯罪后如何掩盖犯罪行为等内容都一一予以解析。首先透视犯罪行为的生成机理,包括犯罪行为的生存土壤即建筑领域商业贿赂存在的几大滋生环节以及诱发商业贿赂犯罪的内外因素;其次探讨建筑领域商业贿赂犯罪人掩盖犯罪事实各种各样的手段,贿赂犯罪的手段更加趋于隐蔽化、智能化,侦查与反侦查的斗争越来越激烈,回扣、佣金、赌博等形式掩盖贿赂行为的手段比较多见,是商业贿赂犯罪所采用的传统手法,然而,随着反腐败斗争的不断深入,权钱交易的违纪违法案件出现了不少新情况、新特点,违纪违法者的手法不断翻新,企图钻法律空子。第三部分关于建筑领域商业贿赂犯罪的侦查对策。此部分紧密承接第二部分,是本文研究的重点之在,集中体现了本文的研究目的。建筑领域商业贿赂犯罪案件侦查是一门全新的课题,案件具有自身的特殊性,侦查工作的开展也有一定的规律可循,但此类案件行业性较强,需要侦查人员掌握建筑行业的相关知识,善于发现侦查线索,及时破获案件。为了便于分类研究,文章把侦查对策分为两大部分,一是微观层面的侦破方略,包括侦查突破口的选取,侦查策略的运用。应该说,由于建筑领域商业贿赂行为的特殊性,决定了侦查机关实际所采用的各种侦查方法和策略也与其他类犯罪案件不同,因此,针对不同案件选准合适的侦查途径就显得非常必要。二是宏观层面的侦查机制。商业贿赂犯罪尤其是建筑领域的贿赂犯罪随着时代的变迁和社会的发展出现了新的特点,对传统的贿赂犯罪侦查工作提出了新的挑战。为了应对新的挑战,侦查机关必须在贿赂犯罪侦查机制方面进行改革和创新。对商业贿赂犯罪的侦查工作是个复杂的系统工程,也是个长期的过程。因此必须探索建立并完善查处商业贿赂犯罪的长效机制,才能形成公平竞争的良好市场秩序,同时也能更好地推动党风廉政建设和反贿赂工作。

The writing of this paper in reference to a large number of pioneering, foundation of good literature and journals of the representative, by comparison, history, logic verification and other research methods, aiming at the particularity of research methods of criminal investigation, in order to enhance the persuasive, with particular emphasis on the empirical methods, many places in this paper in the reasoning after as much as possible additional in recent years occurred in the case to prove, to the most, the most persuasive facts to prove the point.
This article is divided into three parts, about thirty-two thousand words.
The first part is an overview of commercial bribery in the field of architecture.
