【摘要】： 本文从比较法视角对我国刑事司法精神病学鉴定启动制度进行了研究。鉴定结论作为证据类型之一在各国司法实践中均运用十分广泛,刑事司法鉴定的启动制度大多规定于刑事诉讼法律体系之中。司法精神病学鉴定是司法鉴定体系中自身特性较为突出的一个鉴定类型,各国多有特殊规定。我国当前关于司法鉴定的法律法规尚不健全,尤其是司法精神病学鉴定的相关制度仍有待完善。本文立足于当前我国刑事司法精神病学鉴定启动制度相关的法律法规,结合司法鉴定实践的实际情况,提出现阶段我国刑事司法精神病学鉴定启动制度中存在的主要问题,并进行了深入的分析和探讨。文章围绕刑事司法精神病学鉴定启动制度这一核心,系统的收集整理了英美法系和大陆法系典型代表国家的相关规定,提炼出刑事诉讼法典、法律、案例中关于司法精神病学鉴定启动制度的原则、规则和具体法律规定。通过比较研究,分析各国制度的利弊及在我国进行法律移植的基础。结合我国的司法实践现状,提出对现行刑事司法精神病学鉴定启动制度的思考,以期解决当前行刑事司法精神病学鉴定启动制度不完善带来的各种问题,为司法精神病学鉴定制度以及广义的司法鉴定制度的完善提出新的思路和设想。
[Abstract]:This paper studies the initiation system of forensic psychiatry in China from the perspective of comparative law. As one of the types of evidence, the conclusion of appraisal is widely used in the judicial practice of various countries. The initiation system of criminal judicial identification is mostly stipulated in the legal system of criminal procedure. Forensic psychiatry is one of the most prominent types of identification in the system of forensic identification. There are many special provisions in many countries. The current laws and regulations on forensic expertise in China are not perfect, especially the related system of forensic psychiatry is still to be perfected. This article is based on the current criminal judicial psychiatry identification system related to the relevant laws and regulations, combined with the actual practice of forensic expertise. This paper puts forward the main problems existing in the initiation system of criminal judicial psychiatry identification in our country at present, and carries on the thorough analysis and the discussion. The article revolves around the criminal judicial psychiatry appraisal initiation system this core. Systematic collection and collation of the Anglo-American law system and the continental law system on behalf of the country's relevant provisions, refining the code of criminal procedure law, law, cases on the principles of forensic psychiatry identification start system. Rules and specific legal provisions. Through comparative study, this paper analyzes the advantages and disadvantages of national systems and the basis of legal transplantation in China. Combined with the current situation of judicial practice in China. Put forward the current criminal judicial psychiatry identification start system thinking, in order to solve the current criminal judicial psychiatry identification initiation system caused by imperfect problems. New ideas and ideas are put forward for the perfection of forensic psychiatry identification system and the broad forensic expertise system.
