治安防控的经济分析

【摘要】： 治安防控体系建设是全社会都十分重视的犯罪应对举措，各级政府都希望以此来扭转犯罪多发的态势，甚至在某种程度上追求所谓的“零”发案。或许正是由于社会，尤其是政府官员对此寄予了厚望，因而在具体操作中，，又存在急功近利的现象，不顾实际盲目投入，或贪大求全或追求奢华，以至造成了防控资源的巨大浪费。基于对这种现象的反思，本文采用经济分析的进路，分析了犯罪和治安防控的经济属性，论证了治安防控应当追求的犯罪控制目标和尺度，探讨了治安防控的发展方向，进而对事关治安防控成效、目前刑法及犯罪理论界存在的认为我国应对犯罪惩治实行“轻刑化”的观点进行了反思。与现实的治安防控体系建设所追求的犯罪要无限下降的目标相反，本文提出并论证了治安防控不可能无限度降低发案、甚至不可能大幅度降低犯罪的观点；论证并得出了在目前社会条件下防控犯罪应重点提高惩罚严厉程度且应“放纵”一定量的犯罪存在的结论；提出了强化犯罪防控力度应当重视包括法家思想在内的传统刑罚文化的建议。这些与对治安防控传统认识相左的观点尽管听来可能有些“不顺耳”，但对犯罪防控资源相对匮乏的社会现实来讲，尤其是对握有防控资源何去何从大权的决策者来讲，无疑具有“清醒剂”的作用。
[Abstract]:The construction of the system of public security prevention and control is a crime response that the whole society attaches great importance to. Governments at all levels hope to reverse the trend of crime, and even to some extent pursue the so-called "zero" crime. Perhaps it is because of the society. In particular, government officials have placed great hopes on this, so in the concrete operation, there is a phenomenon of eager achievement and instant profit, regardless of the actual blind input, or greedy for perfection or the pursuit of luxury. Based on the reflection of this phenomenon, this paper analyzes the economic attributes of crime and public security prevention and control by using the way of economic analysis, and demonstrates the goal and scale of crime control which should be pursued by public security prevention and control. The development direction of public security prevention and control is discussed, and the effectiveness of public security prevention and control is concerned. At present, the view that our country should implement light punishment in criminal law and crime theory is reflected. Contrary to the goal that crime should be reduced infinitely by the construction of public security prevention and control system in reality, This paper puts forward and demonstrates the view that public security prevention and control can not reduce the crime without limit, or even reduce the crime substantially; The conclusion that the crime prevention and control should focus on raising the severity of punishment and "indulging" the existence of a certain number of crimes under the current social conditions; This paper puts forward some suggestions that we should attach importance to the traditional penalty culture, including the thought of Legalists. These views are contrary to the traditional understanding of public security prevention and control, although it may sound a little "unpleasant" to the crime prevention and control, but the crime prevention and control may not be easy to hear. As far as the social reality of the relatively scarce resources is concerned, Especially for the decision-makers who hold the resources of prevention and control, there is no doubt that they have the function of sobriety.
