论网络环境下知识产权犯罪原因与预防

【摘要】：随着科学技术的发展，网络的影响力不断增大，而网络本身具有的开放性，使得网络环境比一般传统环境更容易成为犯罪分子实施犯罪的场所。在网络时代，侵犯知识产权犯罪呈现出新的表现形式，即网络环境下知识产权犯罪，其危害性随着网络的进步日益增大，它所带来的危害和影响远远超过了传统的知识产权犯罪。网络环境下的种种侵犯知识产权的违法犯罪行为，不但给知识产权所有人带来巨大的损失，而且对于知识产权专有性、地域性等传统特征带来了巨大的冲击并提出全面革新的要求。但是，网络环境下知识产权犯罪做为一种新的犯罪现象，法学理论界对其研究尚处于初步阶段，仍不成熟，其所涉及的许多问题都难以达成共识。在网络环境下知识产权犯罪日益猖狂的今天，为了能够有效的遏制其蔓延，笔者认为需要从理论上着重研究网络环境下知识产权犯罪发生和泛滥的原因，从而针对这些原因而去制定防范的对策。本文分为四个部分。第一部分网络环境下知识产权犯罪概述，论述了网络环境下知识产权犯罪的概念、特征、及其现状。第二部分网络环境下知识产权犯罪的犯罪人因素，从犯罪人的自然属性、犯罪动机和法律意识等方面加以论述，，通过揭示犯罪人的特征和其犯罪原因，为提出有效的预防对策打下基础。第三部分网络环境下知识产权犯罪的社会原因，从引发犯罪的经济因素、法治因素和道德因素三方面论述，对认清犯罪本质，掌握犯罪规律有着重要作用。第四部分为网络环境下知识产权犯罪防治与对策，从提高重点人群的防范意识、立法完善、加强犯罪侦查取证和加强行政保护等四个方面提出网络环境下知识产权犯罪的防治对策。
[Abstract]:With the development of science and technology, the influence of the network is increasing, and the openness of the network makes the network environment more likely than the traditional environment to become a place for criminals to commit crimes. The crime of infringing intellectual property presents a new form, that is, the crime of intellectual property in the network environment, and its harmfulness increases with the progress of the network. The harm and impact it brings far exceeds the traditional intellectual property crimes. All kinds of illegal and criminal acts of infringing intellectual property rights under the network environment not only bring huge losses to the intellectual property owners, but also bring about the proprietary nature of intellectual property rights. The traditional characteristics, such as regionality, have brought great impact and put forward the requirement of comprehensive innovation. However, as a new criminal phenomenon, the research of intellectual property crime in the network environment is still in its initial stage and still immature. Many of the issues involved are difficult to reach consensus. Under the network environment, intellectual property crime is increasingly rampant today, in order to effectively curb its spread, the author thinks it is necessary to focus on the theoretical study of the causes of the occurrence and proliferation of intellectual property crimes in the network environment. In view of these reasons and to formulate preventive countermeasures. This paper is divided into four parts. The first part is an overview of intellectual property crime under the network environment, and discusses the concept, characteristics, and current situation of the intellectual property crime under the network environment. The second part is the criminal factors of the intellectual property crime under the network environment. In this paper, the author discusses the nature, motive and legal consciousness of the criminal, and reveals the characteristics of the criminal and the reasons for his crime. The third part discusses the social causes of intellectual property crime in the network environment, discusses the economic factors, the rule of law and the moral factors, and makes a clear understanding of the nature of the crime. Mastering the law of crime plays an important role. Part 4th is the prevention and control of intellectual property crimes under the network environment. The prevention and cure countermeasures of intellectual property crime under network environment are put forward from four aspects: strengthening criminal investigation and collecting evidence and strengthening administrative protection.
