【摘要】： 黑社会(性质)组织犯罪作为一种新型犯罪,理论上存在许多争论,司法实践中也存在许多疑惑。本文试图在探讨国内外黑社会性质组织犯罪(有组织犯罪)的形成、沿革、基本特征、犯罪原因、侦查对策的基础上,以调查分析的方法,对照我国法律规定的黑社会性质组织的四个基本特征,对2006年山东省公安机关以涉嫌组织、领导、参加黑社会性质组织罪移送起诉的12起案件进行个案分析,分析我省黑社会性质组织犯罪的具体特点,探讨我省黑社会性质犯罪的犯罪原因,提出我省黑社会性质组织的犯罪原因主要由社会的基本矛盾决定,在社会管理失控的条件下,客观存在的“地下市场”或“黑色市场”,二者结合形成一个“暴利市场”,而建立、维护这个市场依靠个体的力量无法完成,必然形成组织和使用暴力作为手段,同时针对我省的侦查工作实际,借此提出相应的侦查对策,以求对司法实践有所帮助。
