人权视野中的犯罪控制和打击

【摘要】：面对犯罪率不断上升的客观现象,既要清醒地认识到,不存在天生的犯罪人,犯罪是各种因素的综合体现,犯罪率上升是社会经济发展到一定阶段的必然结果;又要明确地肯定,犯罪率是可以有效控制的。在强调严厉打击犯罪仍然是最有威慑力的手段的同时,必须改变传统的犯罪对策观念和犯罪对策体系,立足于中国的国情看待打击犯罪的积极意义。为了达到最佳的效果,对犯罪的打击应当合乎法理、伦理和情理;应当正确处理好打击犯罪与保护人权的关系。
[Abstract]:Facing the objective phenomenon of rising crime rate, it is necessary to realize soberly that there are no born criminals, that crime is a comprehensive embodiment of various factors, and that the rise of crime rate is the inevitable result of the social and economic development to a certain stage. It must also be clearly affirmed that the crime rate can be effectively controlled. While emphasizing that cracking down on crime is still the most deterrent means, we must change the traditional concept of crime countermeasures and the system of crime countermeasures. In order to achieve the best effect, the attack on crime should conform to the legal principle, ethics and reason, and the relationship between the fight against crime and the protection of human rights should be correctly handled.
