【摘要】： 盗窃犯罪是常见的多发性侵犯财产犯罪，，近几年来，在我国的刑事案件案发率中占有相当高的比例。盗窃犯罪的高发大大降低了公众的社会安全感，是社会的不和谐因素，因此我们必须重视这个问题。自犯罪这种社会现象出现以来，如何有效预防犯罪，最大限度减少其对社会的危害，成为理论学界的追求。尤其在社会发展过程中，犯罪更被视为一种公害，而被许多国家纳入重点防治范畴。我国在犯罪预防方面的研究已经比较成熟，本文在借鉴前人的研究成果的基础之上，旨在通过对盗窃犯罪产生的原因的分析基础之上，寻求有针对性地、行之有效的预防对策，以期达到降低盗窃犯罪发案率的目的。本文首先简单介绍与盗窃犯罪有关的理论问题，包括了盗窃犯罪的概念、现状、特点和危害，通过对于这些基本问题的介绍，为后面的论述作一个铺垫。然后介绍盗窃犯罪的形成原因，通过对于盗窃犯罪形成原因的分析，能进一步了解盗窃犯罪案发率高的原因。只有找到了原因，才能有针对性地提出预防措施。在这部分的分析中，本文主要运用了刑法的经济分析方法和社会学的分析方法，从犯罪成本和社会因素的角度入手，进而得出结论盗窃犯罪和其他侵犯财产类的犯罪比较而言，犯罪成本相对来说较低，犯罪预期收益往往比预期成本多，再加上经济的发展、贫富差距的加大、失业和无业等社会不稳定因素的存在以及相应社会管理职能缺失这些诸多因素导致了盗窃犯罪的高案发率。本文从四个方面论述了盗窃犯罪的预防问题。首先，讨论盗窃犯罪的刑罚预防，本部分主要运用了经济学的相关理论，引入博弈模型和犯罪的成本—收益曲线模型，希望探讨投入多少刑罚成本才能达到犯罪预防的均衡，并且对于我国现有的刑罚预防体系进行评价，希望能找到改进之处；其次，讨论盗窃犯罪的社会预防。笔者论述了盗窃犯罪的社会成因，这部分主要是针对盗窃犯罪的社会成因提出盗窃罪的社会预防措施，这些措施主要包括：社会改革社会本体的建设与以及社会政策的完善；再次，讨论盗窃犯罪的治安预防，因为很多盗窃行为在没有构成盗窃罪的时候是被纳入治安处罚的评价范围，因此讨论盗窃的治安预防有现实的积极意义。本文在借鉴前人的研究基础上，提出了治安预防的具体措施：即加强户口管理、加强公共场所治安管理、加强社区治安管理。最后，讨论盗窃犯罪的被害预防，这是一个比较新的角度，从被害人的视角探讨如何有效地防止被盗窃犯罪侵害。本文借鉴一些刑事侦查专家的观点，提出了被害预防的一些具体措施。
[Abstract]:Theft is a common crime of infringing property. In recent years, it occupies a high proportion of criminal cases in our country. The high incidence of theft greatly reduces the social security of the public and is a factor of disharmony in the society. Therefore, we must pay attention to this problem. Since the emergence of crime as a social phenomenon, how to effectively prevent crime and minimize its harm to society has become the pursuit of academic circles. Especially in the process of social development, crime is regarded as a public hazard. The research on crime prevention in our country has been quite mature. Based on the previous research results, this paper aims to analyze the causes of the crime of theft. In order to reduce the crime rate of theft, effective preventive countermeasures are sought. This paper first briefly introduces the theoretical problems related to the crime of theft, including the concept, current situation, characteristics and harm of the crime of theft. Then introduce the causes of the crime of theft. Through the analysis of the reasons for the formation of the crime of theft, we can further understand the reasons for the high rate of crime of theft. Only the reasons have been found. In this part of the analysis, this article mainly uses the economic analysis method of criminal law and the analysis method of sociology, starting from the angle of crime cost and social factors. Furthermore, it is concluded that the crime cost is relatively low and the expected proceeds of crime tend to be higher than the expected costs, in addition to the economic development and the widening gap between the rich and the poor, as compared with the crime of theft and other crimes against property. The existence of social instability, such as unemployment and unemployment, and the lack of corresponding social management functions lead to a high incidence of theft. This paper discusses the prevention of theft crime from four aspects. Firstly, it discusses the penalty prevention of theft crime. This part mainly uses the relevant theories of economics, and introduces the game model and the cost-benefit curve model of crime. It is hoped to explore how much penalty cost can be invested to achieve the balance of crime prevention, and to evaluate the existing penal prevention system in China, hoping to find some improvements; secondly, The author discusses the social causes of the crime of theft, which is mainly aimed at the social causes of the crime of theft and puts forward the social preventive measures of the crime of theft. These measures mainly include: the construction of social reform social ontology and the perfection of social policy; thirdly, the discussion on the crime of theft security prevention, Because many acts of theft are included in the evaluation scope of public security punishment when they do not constitute the crime of larceny, it is of practical positive significance to discuss the public security prevention of theft. This paper puts forward some concrete measures for the prevention of public security: strengthening the management of residence registration, strengthening the management of public security, and strengthening the management of public security. Finally, the paper discusses the prevention of the crime of theft, which is a relatively new angle. From the perspective of the victim, this paper discusses how to effectively prevent the crime from being stolen. This paper draws on the views of some experts in criminal investigation and puts forward some concrete measures for the prevention of victimization.
