农村征地领域内职务犯罪特征、生成机制及惩防对策研究

【摘要】：土地,在当前中国,依然是绝大多数农民的生存之源,生活之本。随着我国城镇化进程逐步加快以及新农村建设的积极推进,各级政府对农村基础设施建设等方面的投资力度也不断加大,与此同时,对农村集体土地的征用量也自然相应不断增加。近年来,涉及农村征地过程中的职务犯罪日渐突出、犯罪频发,不少案件性质恶劣,社会影响巨大,已经成为社会关注的热点,同时也是当前一个时期反腐败工作的重点、难点。另外,这类案件往往涉及人数众多、影响面广,稍有不慎就会引发群体性事件,譬如,不少地方发生了,农民阻工、集体上访、与政府打官司、甚至与开发商直接发生武力冲突、自焚等事件,这一系列征地问题引发的群体性事件,折射出的消极危害已经远远超过了事件本身带来的影响,它深刻的反映着农村征地领域职务犯罪问题已经成为影响我国社会稳定的重大问题。类似问题的态势日益严重,造成的影响十分恶劣,我国党和政府也已经积极的做了回应,在一定程度上成效还是十分显著的。例如,2010年2月9日,最高人民法院公布了《关于贯彻宽严相济刑事政策的若干意见》。《意见》明确规定,对发生在征地拆迁等领域严重损害群众利益、社会影响恶劣、群众反映强烈的国家工作人员职务犯罪须重判。笔者在写作过程中,在参考诸多前沿性、权威性资料的同时,结合调查得到的实际案例,运用历史、实证、经济分析等研究方法,对农村征地领域内的职务犯罪概况进行了粗浅梳理,并试图整理出相关环节职务犯罪某种程度上的共性徽征,进而针对该领域的职务犯罪提出了一些建构惩防对策建议。我认为,防止和打击该领域的职务犯罪,对当前推进城市化进程和新农村健康建设、乃至和谐社会的构建具有一定理论和现实意义。本文共分四章,约三万六千字。第一章是关于农村征地领域内职务犯罪的概述,该部分简要对农村征地领域内职务犯罪的基本概念进行了剖析,重点从土地征用、征收制度的法经济学视角,对农村征地过程中职务犯罪所关涉主体间利益冲突及行为趋向作了分析,为后文探究其犯罪生成机制作了铺垫。第二章是关于农村征地领域内职务犯罪特征及危害性阐述。结合调研数据和实证案例,详细具体地分析了该类案件的目前态势,重点对纷繁复杂的案例进行了深入的定性和定量研究,通过较为详实的数据解析,对其犯罪徽征作了较为深入的探讨。第三章从唯物辩证主义的基本原理出发,按层层剥笋似的步骤,由外向里,层层剥离顺序即按照个体微观表层原因——反推中层原因——深层原因,对该领域职务犯罪的由表层——深层,由金字塔形因素构成的原因综合体作了剖析。第四章是惩防建构部分,“一个良好的立法者关心预防犯罪多于惩罚犯罪,注意激励良好的风俗多于施行刑罚”——【法.孟德斯鸠】本部分先从抑制职务犯罪的相关措施的效能指数入手,大致按照效能功效程度,建构惩防体系,其中主要试图通过制度预防,来遏制该领域的职务犯罪。
[Abstract]:Land , in the present China , is still the source of the subsistence of the vast majority of farmers . As the process of urbanization of our country is accelerating and the construction of new countryside actively promotes , the governments at all levels have increased their investment in the construction of rural infrastructure .

On February 9 , 2010 , the Supreme People ' s Court issued a number of suggestions on the implementation of the criminal policy of enforcing the law .

In the process of writing , the author makes a brief analysis of the general situation of professional crimes in the field of rural land acquisition by using the methods of historical , empirical and economic analysis , and tries to put forward some suggestions on how to construct and punish the crime in the field . I believe that the prevention and suppression of the crime of duty in the field has some theoretical and practical significance to the current advancement of urbanization and the construction of new rural health , and even the construction of harmonious society .

This article is divided into four chapters , about thirty - six thousand words .

Chapter One is an overview of the work crime in the area of rural land acquisition . This part analyzes the basic concept of professional crime in the area of land requisition , focusing on the legal and economic perspective of land acquisition and collection system , analyzes the interests conflict and behavior trend of the main subject in the course of rural land acquisition , and lays a cushion for the inquiry of its crime generating mechanism .

The second chapter is about the characteristics of professional crime and its harmfulness in the field of rural land acquisition . Combined with the investigation data and the case study , the current situation of the case is analyzed in detail , and the detailed qualitative and quantitative research is carried out on the complicated cases .

In chapter 3 , starting from the basic principle of dialectical materialism , according to the step of peeling bamboo shoots by layer , the reason _ deep reason of the reason _ the reason _ of inter - layer peeling of the individual micro - surface layer is put forward , and the reason complex composed of pyramid - shaped factors is analyzed .

The fourth chapter is the part of the penal system , " a good legislator cares more about crime prevention than punishing crime , paying attention to encouraging good customs more than imposing punishment " . Montesquieu

This part starts with the effectiveness index of the relevant measures to restrain the crime of the job , and constructs the system of punishment and defense according to the efficiency degree , which mainly tries to prevent the crime in this area through the system prevention .
