【摘要】： 未成年人犯罪是一个世界性的难题,在中国也毫无例外地引起了全社会的高度关注。中国作为世界上人口最多的国家,未成年人的基数较大,整个中国社会正处于转型时期,情况更为复杂,问题更加严峻。预防未成年人犯罪,必须掌握未成年人犯罪的特点和成因。在中国,近些年来,未成年人犯罪在保持一些固有特点的同时,又呈现出很多新的特点,如突发性、暴力性、模仿性等,必须引起我们高度重视。而且其发展的趋势并不令人乐观,低龄化、团伙化、智能化、侵财犯罪比重加大都令人堪忧。探讨未成年人犯罪问题,我们必须要研究未成年人犯罪的原因。从微观角度讲,犯罪是一个个体行为;从宏观角度讲,它又是一种社会现象。虽然未成年人犯罪的每一例个案都有其特殊的原因,但是未成年人犯罪作为一种复杂的社会现象,其成因是一个由诸多因素形成的体系。因此,造成未成年人犯罪的原因既有未成年人个体的生理特征、心理特征的影响,又有家庭、学校、社会等外在因素的影响。本文试图从法学、社会学、心理学的视角出发,沿着提出问题、阐释问题、分析问题、解决问题的逻辑思维脉络,结合青少年教育、保护工作中的一些相关资料,通过对未成年人犯罪现状及类型特点的分析,从社会、个人自身尤其是家庭的角度对未成年人的犯罪原因进行了探究,最后对预防未成年人犯罪这一课题进行分析、阐述,提出一些可资借鉴参考的对策性建议。
[Abstract]:Juvenile delinquency is a worldwide problem, which has aroused great concern from the whole society in China without exception. As the most populous country in the world, China has a relatively large base of minors, and the whole Chinese society is in a period of transition. The situation is more complicated and the problem is more serious. In order to prevent juvenile delinquency, we must grasp the characteristics and causes of juvenile delinquency. In China, in recent years, while maintaining some inherent characteristics, juvenile delinquency has taken on many new characteristics, such as sudden and violent. We must attach great importance to imitation, and the trend of its development is not optimistic, younger age, gang, intelligence, increase the proportion of crime against money are worrying. In order to discuss the problem of juvenile delinquency, we must study the causes of juvenile delinquency. From a microscopic perspective, crime is an individual act; from a macro point of view, It is also a social phenomenon. Although every case of juvenile delinquency has its own special reasons, as a complex social phenomenon, the causes of juvenile delinquency are a system formed by many factors. The causes of juvenile delinquency are not only the influence of individual physiological and psychological characteristics of minors, but also the influence of family, school, society and other external factors. From the perspective of law, sociology and psychology, this paper tries to follow the logical thinking of raising questions, explaining problems, analyzing problems and solving problems, combining with some relevant materials in juvenile education and protection work. Through the analysis of the current situation and type of juvenile delinquency, this paper probes into the causes of juvenile delinquency from the point of view of society, individuals, especially families, and finally analyzes and expounds the subject of preventing juvenile delinquency. Some suggestions for reference are put forward.
