中国社区矫正制度研究

【摘要】：2013年11月12日随着第十八届三中全会的闭幕，《中共中央关于全面深化改革若干重大问题的决定》明确提出废止劳教制度，健全社区矫正制度。这不仅是中国人权的进步，更对我国刑罚执行制度的创新提出了要求。社区矫正制度在国际社会已被人们熟知，在西方发达国家更是发展完善。在我国，社区矫正是指将被判处管制、被宣告缓刑、被暂予监外执行、被裁定假释等符合条件的罪犯置于社区内，在判决、裁定或决定确定的期限内，由专门的国家机关进行矫正，通过社会团体、民间组织、社会志愿者的协助，对罪犯进行教育矫正、监督管理、帮困扶助，促使其顺利回归社会的活动。社区矫正以其人性化的管理教育、节约行刑资源等独特的优势逐渐被社会接受，最终被纳入刑法。然而我国的社区矫正制度实行晚、经验少、体系乱，如何切实地完善社区矫正制度，，使其更好地发挥效用，成为我们具体行刑中不得不面对的难题。本文主要针对我国社区矫正制度的施行现状进行研究，分析了我国过去几年里社区矫正制度的发展历程，介绍了国外社区矫正制度的先进经验，通过和国内一些做法的对比，提出了一系列切实可行的操作建议。在论述过程中，运用了理论联系实际法、比较研究法等方法，结合了思想政治教育的相关理论，对实际案例进行了分析论述，试图找到一些切实可行的、有指导意义的操作方法，使其更能符合我国的特殊国情，来构建和谐社会背景下的中国特色刑罚执行制度，以期能对中国社区矫正制度的发展贡献一份微薄之力。
[Abstract]:With the closing of the third Plenary session of the 18th CPC Central Committee on November 12, 2013, the decision of the CPC Central Committee on deepening the reform in an all-round way put forward a clear proposal to abolish the system of re-education through labour and to perfect the system of community correction.This is not only the progress of human rights in China, but also the innovation of penalty enforcement system in China.The community correction system has been well known in the international community and developed in the western developed countries.In China, community correction refers to the placement in the community of prisoners who are sentenced to control, suspended from prison, temporarily executed outside prison, ordered to be paroled, and so on, within the time limit determined by judgment, ruling or decision.Through the assistance of social organizations, non-governmental organizations and social volunteers, the special state organs should carry on the education and correction, supervise and manage the criminals, help them to help and help them to return to the society smoothly.Community correction, with its unique advantages of humanized management education and saving execution resources, was gradually accepted by the society and eventually brought into the criminal law.However, the community correction system in our country is implemented late, with little experience and chaotic system. How to improve the community correction system and make it more effective has become a difficult problem that we have to face in the execution of punishment.This paper mainly studies the present situation of community correction system in our country, analyzes the development course of community correction system in China in the past few years, introduces the advanced experience of foreign community correction system, and compares it with some domestic practices.A series of practical suggestions are put forward.In the course of the discussion, the author uses the methods of combining theory with practice, comparative research and other methods, combines the relevant theories of ideological and political education, analyzes and discusses the actual cases, and tries to find some feasible ones.The instructive operation method makes it more suitable for the special situation of our country to construct the penalty execution system with Chinese characteristics under the background of harmonious society in order to contribute a meager contribution to the development of Chinese community correction system.
