【摘要】：作为刑事侦查学基础理论的重要内容之一，刑事侦查目的论的研究具有十分重要的理论和现实意义。本文从目的的哲学深意出发，在对刑事侦查目的理论历史演进进行介绍、评价和对构建我国科学刑事侦查目的的各种制约因素进行全面考量、分析的基础上，提出了刑事侦查的直接目的是查明案件事实，追求个案公正与社会效益；刑事侦查的根本目的是化解冲突、保障有序、促进和谐，文章最后对刑事侦查目的理论研究的意义进行了简要的阐释。全文共分为四个部分，共计三万余字。第一部分为刑事侦查目的理论的概说。旨在寻求侦查目的构建的理论基础，这一部分主要论述了目的的哲学含义、与目的相关的几个概念及其与目的的关系、刑事侦查目的与刑事诉讼目的、人类社会活动的目的关系以及刑事侦查目的理论的历史形态。第二部分为构建我国科学侦查目的需要考量的因素。主要从社会视角、法治视角以及侦查本体视角分析论证了科学侦查目的立论基础。具体涉及对历史传统、现实条件、法治进程、刑事一体化、刑事诉讼过程以及侦查模式、侦查构造、控制犯罪、保障人权等范畴的剖析。第三部分为刑事侦查目的理论的展开。这一部分是文章的主体，首先论述了刑事侦查目的有直接目的与根本目的的层次之分以及二者之间的关系，接下来着重论证了刑事侦查目的具体内容，即刑事侦查的直接目的是查明案件事实，，追求个案公正与社会效益；刑事侦查的根本目的是化解冲突、保障有序、促进和谐。旨在揭示侦查目的“是什么”以及“为什么是”。第四部分为刑事侦查目的研究的意义。将这一内容安排在文章的结尾主要是出于文章内容完整性和结构合理性的考虑。这一部分简要探讨了刑事侦查目的研究对刑事侦查学基础理论、刑事侦查立法和刑事侦查实践三个方面的意义。
[Abstract]:As one of the important contents of the basic theory of criminal investigation , the research of the objective theory of criminal investigation has very important theoretical and practical significance . In this paper , based on the introduction , evaluation and comprehensive consideration of all kinds of restriction factors for the purpose of criminal investigation , the article puts forward that the direct aim of criminal investigation is to find out the facts of the case and to pursue the fair and social benefits of the case .
The fundamental purpose of criminal investigation is to resolve the conflict , safeguard the order and promote the harmony . The article gives a brief explanation of the significance of the theory of criminal investigation .

The full text is divided into four parts , totaling more than 30,000 words .

The first part is an overview of the theory of criminal investigation purpose . The aim is to find the theoretical basis of the construction of criminal investigation . This part mainly discusses the philosophical meaning of the purpose , the relation between the purpose and the purpose , the purpose of criminal investigation and the purpose of criminal procedure , the purpose of human social activity and the historical form of the theory of criminal investigation purpose .

The second part is the factors that need to be considered for the purpose of constructing the scientific investigation object in our country . It mainly analyzes the object of scientific investigation from the angle of society , the angle of law and the angle of investigation body . It also involves the analysis of historical tradition , realistic condition , rule of law process , criminal integration , criminal procedure , investigation mode , investigation structure , control crime and guarantee human rights .

The third part is the development of the theory of criminal investigation purpose . This part is the main body of the article . Firstly , it discusses the relationship between the direct aim and the fundamental purpose of criminal investigation and the relationship between them . Then , it mainly discusses the specific contents of the purpose of criminal investigation , that is , the direct aim of criminal investigation is to find out the facts of the case and to pursue the fair and social benefits of the case ;
The fundamental purpose of criminal investigation is to resolve conflicts , safeguard orderly and promote harmony .

The fourth part is divided into the significance of the research of the purpose of criminal investigation . The conclusion of this content is mainly from the consideration of the completeness of the content and the rationality of the structure . This part briefly discusses the significance of the investigation of criminal investigation on the basic theory of criminal investigation , the legislation of criminal investigation and the practice of criminal investigation .
