关于中国劳动教养制度的思考

【摘要】：劳动教养是我国对有违法和轻微犯罪行为人实行强制性教育改造的一种法律制度。近半个世纪来,我国的劳动教养制度教育、感化和挽救了一大批违法犯罪人员,为巩固新生的人民民主政权,促进社会主义现代化建设起到重要作用。但也应该看到,这一制度尚未完全适应我国法治进程的需要。它与行政处罚制度、刑罚制度存在矛盾,与我国日益重视人权的司法保护发展趋势不符,人们对这一制度的存废之争也由来已久。本文试图通过对我国劳动教养制度的历史考察,剖析其存在的理论缺陷与实践不足,并从理想与现实结合的视角,提出完善和发展这一制度的路径和方法。
[Abstract]:Reeducation through labor is a kind of legal system of compulsory education reform for perpetrators of illegal and minor crimes in our country. In the past half century, the education of reeducation through labor system in our country has influenced and saved a large number of illegal and criminal personnel, which plays an important role in consolidating the new people's democratic regime and promoting the socialist modernization. However, it should also be noted that this system has not fully adapted to the needs of the process of rule of law in our country. It is inconsistent with the system of administrative punishment and the system of penalty, and does not accord with the development trend of judicial protection of human rights in our country. People have a long history of controversy about the existence and abolition of this system. This paper attempts to analyze the theoretical defects and practical deficiencies of the system of reeducation through labor in China, and from the perspective of the combination of ideal and reality, puts forward the ways and methods to perfect and develop this system.
