【摘要】： 本文系运用包涵比较、历史分析、解释学、社会学、心理学等方法的复杂性研究方法论对腐败犯罪控制问题进行的综合性研究,其研究路径在于从对腐败犯罪现象的理性观察到以制度为基本方式的综合性腐败犯罪控制框架的建构。因此,本文主要由两部分组成:一是腐败犯罪控制本体论,包括对腐败犯罪的全面认识、控制腐败犯罪的法律现状与基本模式、腐败犯罪控制的含义与基本原则等;二是腐败犯罪控制运行论,包括对犯罪人的心理解析、反腐法律框架的完善、反腐机构的设置及反腐国际合作的加强等。腐败犯罪控制本体论侧重于从静态角度对腐败犯罪控制的基础性问题进行阐述;在此基础上的运行论则偏好于将反腐工作作为一个动态的过程,力求以制度(尤其是刑事法律制度)来建构综合性的控制框架,从对打击和惩罚的迷恋转向预防与惩治并重,从单纯的控制腐败犯罪回归于法治理念的指引,从一国视角下的反腐变迁为全球视角下的国际合作反腐。
[Abstract]:This paper is a comprehensive study of corruption crime control by using the complexity research methodology of inclusion comparison, historical analysis, hermeneutics, sociology, psychology, etc. The research path is from the rational observation of the corruption crime phenomenon to the construction of the comprehensive corruption crime control framework based on the system. Therefore, this paper mainly consists of two parts: first, the ontology of corruption crime control, including the overall understanding of corruption crime, the current legal situation and basic mode of corruption crime control, the meaning and basic principles of corruption crime control, etc. The second is the theory of the operation of corruption crime control, including the psychological analysis of the criminal, the perfection of the anti-corruption legal framework, the establishment of the anti-corruption organization and the strengthening of the international cooperation against corruption, etc. The ontology of corruption crime control focuses on the basic problems of corruption crime control from the static point of view, while the operation theory on this basis prefers to take anti-corruption work as a dynamic process. In order to construct a comprehensive control framework with the system (especially the criminal law system), from infatuation to prevention and punishment, from the pure control of corruption crime to the guidance of the concept of rule of law. From the perspective of a country to the change of international cooperation in the global perspective of anti-corruption.
