应激障碍的司法精神病学鉴定问题

【摘要】：正 随着生活节奏加快、社会竞争剧烈,给人们带来更多的应激因素,使有关精神障碍的发生率日渐增多起来,其中较为突出的是应激相关的精神障碍问题,患者受到精神症状影响可发生刑事案件,也可经常上访而妨碍社会正常秩序,特别多见的是关于法律关系鉴定。在这些案件的审理过程中,常需委托司法精神病学鉴定,鉴定结论又常受到多种客观因素影响及鉴定人主观认识方面的差异而出现分歧,因此需要重复鉴定的案例很多,这类案件的社会影响面也通常较大,受到社会舆论的关注也是不言而喻的。有鉴于此,本文拟对本专题在日常鉴定中有关问题进行探讨,从同道参考。
[Abstract]:With the quickening pace of life and the fierce competition in society, more stress factors are brought to people, and the incidence of mental disorders is increasing day by day, among which stress related mental disorders are more prominent. Patients affected by mental symptoms can occur criminal cases, but also frequent petitions to interfere with the normal social order, especially on the legal relationship appraisal. In the process of hearing these cases, it is often necessary to entrust judicial psychiatry, and the conclusions of appraisal are often influenced by various objective factors and the differences in the subjective cognition of experts, so there are many cases that need repeated identification. The social influence of this kind of cases is usually larger, and it is also self-evident to be concerned by the public opinion. In view of this, this article intends to discuss the related problems in the daily appraisal of this topic, from the same reference.
