职务犯罪文化初探

【摘要】:当前我国职务犯罪呈现出群体性、扩散性、关联性等新的特征。以研究犯罪原因和犯罪控制为己任的犯罪学应当对这些新的特征做出解释,并提出有效的控制措施。 本文在对西方白领犯罪亚文化理论和我国职务犯罪亚文化理论进行回顾的基础上,总结了这些理论的基本观点和方法,形成了职务犯罪亚文化理论的基本模型,并且,从该模型出发,设定了一系列理论假设。针对这些假设,本文运用文献分析方法,以职务犯罪实际案例为实证材料对这些假设进行了论证,并得出结论:权力和金钱是一些国家工作人员追求的目标,获取实现权力和金钱目标的合法手段是有限的,当追求权力和金钱的国家工作人员缺乏实现目标的制度性手段时,就会有挫折感,如果有机会获得能实现目标的非制度性手段,他就可能通过该手段(即实施职务犯罪行为)来实现目标。如果不仅缺乏制度性手段而且缺乏非制度性手段,或者仅缺乏制度性手段却具有非制度性手段,但有刑罚威慑力等的阻碍,他就会调整自己的目标并重新开始新目标的实现行为。当众多国家工作人员实施了职务犯罪行为时,就形成了一种职务犯罪亚文化群和职务犯罪亚文化。由于职务犯罪亚文化特有的功能和规范能给群体成员以鼓励和支持,这就更增强了该亚文化群对其他国家工作人员的吸引力。同样由于犯罪亚文化群的特有规范,使不遵循该规范的成员得到群体的排斥和惩罚。群体对其成员的这种推拉作用促使其成员遵循其特有规范,遵循的结果就是职务犯罪。上述理论假定不仅可以从实证资料获得证实,而且较好地解释了当前职务犯罪呈现的前述新的特征。因此,作者根据所作的分析,提出预防和控制职务犯罪的相应对策建议。
[Abstract]:At present, the crime of duty in China presents new characteristics such as group, diffusible and related, and the criminology that studies the cause of crime and the control of crime should explain these new features and put forward effective control measures.
On the basis of the review of the western white collar crime subculture theory and the subculture theory of duty crime in China, this paper sums up the basic views and methods of these theories, and forms the basic model of the subculture theory of the duty crime, and sets out a series of theoretical assumptions from the model. The analysis method, taking the actual case of the duty crime as the empirical material, demonstrates these hypotheses, and draws the conclusion that power and money are the goals pursued by some national staff, and the legal means to achieve power and money goals are limited, and the national staff who pursue power and money lack the institutional hands to achieve the goal. In a period of time, there will be a sense of setback. If he has the opportunity to achieve a non institutional means to achieve the goal, he may achieve the goal through the means (i.e. the enforcement of the duty crime). If not only lack of institutional means but lack of non institutional means, or lack institutional means, but have non institutional means, but there is a deterrent force of punishment. He will adjust his goal and start a new goal. When many state workers carry out the crime of duty, they form a subculture of duty crime and the subculture of duty crime. Because of the special functions and norms of the job crime subculture, it can be encouraged and supported by the members of the group. It also strengthens the attractiveness of the subculture to the staff of other countries. Also, because of the specific norms of the subculture group, the members who do not follow the norm get the exclusion and punishment of the group. The push and pull of the group to its members leads the members to follow their specific norms and follow the theory of job crime. The hypothesis can not only be confirmed from the empirical data, but also better explain the new characteristics of the present job crime. Therefore, the author, based on the analysis, puts forward the corresponding countermeasures and suggestions for the prevention and control of the duty crime.
