【摘要】：尽管犯罪模式痕迹在学术上没有明确的界定,但是其在犯罪现场分析过程中的实践应用由来已久,并且相关的经验体会也经常见诸于专业论著之中。犯罪模式痕迹研究范畴的提出,正是我们以科学的方法论作指导,采用更多种类与更多视角的研究方法,实现揭示犯罪规律目的的必然。实践已证明,犯罪模式痕迹是现场勘查技术实施过程中,侦查人员进行现场分析的重要依据。在串并案件、缩小侦查范围、确定案件性质等方面,均具有非常显著的作用。全文除了引言和结论外,共分四个部分。第一部分是犯罪模式痕迹概述。该部分在解析犯罪模式痕迹主要构成的基础上,确定了犯罪模式痕迹的内涵和外延。第二部分是犯罪模式痕迹的基础理论。动力定型原理和同一认定原理是刑事科学技术普遍应用的两个原理。人的任何一种活动习惯都是动力定型的一种表现。动力定型形成以后,当这个系统不断的被重复强化,就会更加稳固,形成“自动化”的行为。由于有些犯罪嫌疑人会不断作案,所以在其反复实施作案活动的过程中养成了稳固的犯罪习惯,形成了犯罪动力定型机制。动力定型的稳定性反映在其是按照固定程序运行的模式,鉴于这种独特的稳定性,犯罪模式痕迹可以作为同一认定的依据。第三部分是犯罪行为习惯痕迹,是犯罪模式痕迹的组成部分之一。由于个体受遗传因素和社会环境因素的相互影响,每个人都会存在差异性。同时,由于长时间的行为动作和生活习惯会养成一种思维定势和行为习惯定势,犯罪嫌疑人在实施犯罪活动时也会反映出这种特性。犯罪模式痕迹在主客观因素的作用下,所形成的行为习惯具有鲜明的独特性、稳定性和反映性。通过对犯罪模式痕迹的解读,可以分析出犯罪嫌疑人的个体生理差异和职业技术特征。第四部分是犯罪心理痕迹。研究犯罪心理痕迹,即在探讨犯罪心理支配下的犯罪现场构成的核心要素—犯罪行为,即在探讨通过犯罪行为所表现出来的犯罪嫌疑人的心理状态以及这种心理状态所表现出来的犯罪动机和目的。犯罪心理痕迹同样也是犯罪模式痕迹的研究内容。本章首先探讨了犯罪心理的产生、犯罪预备以及实施等犯罪心理外化成犯罪行为的过程,之后基于犯罪现场的物质痕迹是犯罪心理分析的基础,通过对犯罪物质痕迹的分析进一步解读犯罪模式痕迹。
[Abstract]:Although there is no clear academic definition of the trace of crime pattern, its practical application in the process of crime scene analysis has a long history, and the relevant experience is often found in professional works. It is the necessity for us to use more kinds of research methods and more angles of view to realize the purpose of revealing the law of crime under the guidance of scientific methodology. It has been proved by practice that the trace of crime pattern is an important basis for investigators to carry out scene analysis in the process of carrying out scene investigation technology. In serial cases, narrow the scope of investigation, determine the nature of cases, have a very significant role. In addition to the introduction and conclusions, the full text is divided into four parts. The first part is an overview of the pattern of crime. On the basis of analyzing the main components of the criminal pattern trace, this part determines the connotation and extension of the criminal pattern trace. The second part is the basic theory of criminal pattern trace. The principle of dynamic stereotyping and the principle of identical recognition are two principles that are widely used in criminal science and technology. Any kind of activity habit of human being is a kind of manifestation of dynamic stereotype. As the system is repeatedly reinforced, the system becomes more stable and forms an "automated" behavior. Because some suspects will continue to commit crimes, so in their repeated implementation of criminal activities in the process of forming a solid criminal habit, forming a criminal motive force stereotype mechanism. The stability of dynamic stereotyping is reflected in the mode of running according to the fixed procedure. In view of this unique stability, the trace of criminal pattern can be regarded as the basis of the same identification. The third part is the trace of criminal behavior, which is one of the components of the pattern of crime. Because individuals are influenced by genetic factors and social environmental factors, there are differences among individuals. At the same time, due to the long time behavior and life habits will form a set of thinking and behavior habits, criminal suspects in the implementation of criminal activities will also reflect this characteristic. Under the action of subjective and objective factors, the behavior habit formed by the criminal pattern trace has distinct uniqueness, stability and reflection. Through the interpretation of the trace of the crime pattern, we can analyze the individual physiological difference and the professional and technical characteristics of the suspect. The fourth part is the trace of criminal psychology. Studying the trace of criminal psychology, that is, the core element of the crime scene under the domination of criminal psychology, that is, criminal behavior, That is to explore the psychological state of the criminal suspect and the motive and purpose of the crime. The criminal psychological trace is also the research content of the criminal pattern trace. This chapter first discusses the process of criminal psychological externalization into criminal behavior, such as the emergence of criminal psychology, the preparation of crime and the implementation of criminal psychology, and then the material trace based on the crime scene is the basis of the analysis of criminal psychology. Through the analysis of the material trace of crime, the author further interprets the trace of the crime pattern.
