流动人口犯罪实证问题研究

【摘要】： 随着我国社会主义市场经济的深入发展,城市中流动人口规模在持续扩大,一方面流动人口的迅速增长为经济繁荣、社会进步发挥了重要作用;但另一方面伴随人口流动增加而带来的社会治安、城市建设、文化教育、社会管理等方面的问题也日渐浮出水面。流动人口在促进社会经济发展的同时,犯罪现象也十分严重,给社会治安增添了新的不安定因素。 本文通过对流动人口犯罪的理论界定,对流动人口和流动人口犯罪的主体进行了深入探讨,给出了流动人口和流动人口犯罪主体的确切定义。应用实证主义研究的方法分析了北京、广东、山东等部分地市的流动人口犯罪的现状、特点和成因。比较剖析了国内外关于流动人口犯罪的各种理论,并从犯罪心理学和犯罪社会学角度提出了自己对流动人口犯罪原因的看法。通过分析我国现有流动人口相关法律所存在的缺陷与不足,提出了应对流动人口犯罪的立法和司法对策。
[Abstract]:With the further development of socialist market economy in our country, the scale of floating population in cities continues to expand. On the one hand, the rapid growth of floating population plays an important role in economic prosperity and social progress. But on the other hand, the problems of social security, urban construction, culture and education, social management and so on are also emerging along with the increase of population mobility. At the same time, the floating population promotes the development of social economy, and the crime phenomenon is very serious, which adds a new unstable factor to the social security. Through the theoretical definition of the crime of floating population, this paper probes into the subject of the crime of floating population and floating population, and gives the exact definition of the subject of crime of floating population and floating population. This paper analyzes the present situation, characteristics and causes of floating population crime in Beijing, Guangdong, Shandong and other cities by means of positivism. This paper makes a comparative analysis of various theories about floating population crime at home and abroad, and puts forward his own views on the causes of floating population crime from the angle of criminal psychology and criminal sociology. Based on the analysis of the defects and shortcomings of the existing laws on floating population in China, this paper puts forward the legislative and judicial countermeasures to deal with the crimes committed by the floating population.
