【摘要】：近年来,随着我国法制建设进程的加快,“法律化、制度化”成为当今中国社会主义建设的根本保证。青少年犯罪作为社会转型时期的特殊标志,研究矫正论在青少年犯罪制度化建设中的实际运用。从研究世界发达国家的先进的矫正制度入手,进一步探讨我国关于青少年犯罪的矫正制度的完善。本文以青少年犯罪矫正制度的产生依据、制度设计目的等入手,阐述青少年矫正制度的特殊性。从分析我国现有青少年矫正制度及不足入手,思考构建青少年司法制度的具体措施及理念。文章明确提出了我国目前青少年犯罪矫正制度的发展完善途径。全文分为四个部分: 第一部分为“矫正论与青少年犯罪矫正制度”,着重从矫正理论的角度论述了矫正学说、矫正论的形成、矫正论与青少年司法制度。是全文的基础和铺垫。第二部分为“我国青少年矫正的产生背景”,以哲学、生理、心理、人文主义和刑罚学等科学理论的视野,点明了我国青少年矫正制度建构的理论背景,强调了青少年矫正的必要性、可行性。是全文的理论依据与出发点。第三部分为“我国青少年矫正制度”,主要论述了青少年矫正制度的原则、青少年犯罪矫正制度的萌芽、青少年犯罪矫正制度的诞生与发展。是全文的核心内容。第四部分为“构建我国现代化青少年矫正制度”,从比较科学的角度阐述了现代矫正制度的目的、构建现代化矫正制度的新理念,并在此基础上提出了一系列的构建我国青少年现代矫正制度的实现途径或建议,如认真研究、借鉴国外先进的矫正制度、在“双向保护”中寻求少年利益的平衡点、完善进入刑事诉讼程序中少年利益的保护制度、纳入矫正范围的青少年年龄下限的界定、建立少年教养院及养护措施、实行社区矫正制度。本文的研究方法是文献法、比较研究法和若干实证调查综合分析法。突破点是打破了传统的青少年矫正观念、探讨了我国青少年矫正制度的不足,提出了一系列带有科学、前卫精神的矫正措施、方法和对策。
[Abstract]:In recent years, with the acceleration of China's legal construction process, "legalization, institutionalization" has become the fundamental guarantee of China's socialist construction. Juvenile delinquency, as a special symbol in the period of social transformation, studies the practical application of correctional theory in the institutionalization of juvenile delinquency. By studying the advanced correction system of the developed countries in the world, this paper probes into the perfection of the correction system of juvenile delinquency in our country. This paper expounds the particularity of juvenile correction system based on the basis and design purpose of juvenile delinquency correction system. Based on the analysis of the current juvenile correction system and its deficiency, the author thinks about the concrete measures and ideas of constructing the juvenile justice system. The article puts forward the way to perfect the system of juvenile delinquency correction in our country. The full text is divided into four parts: The first part is "Correction Theory and Correction system of Juvenile Delinquency", which focuses on the theory of correction, the formation of theory of correction, the theory of correction and the system of juvenile justice. Is the basis of the full text and bedding. The second part is "the background of juvenile correction in our country", which points out the theoretical background of the construction of juvenile correction system from the perspective of philosophy, physiology, psychology, humanism and penal science. The third part mainly discusses the principles of juvenile correction system, the germination of juvenile delinquency correction system, and the birth and development of juvenile delinquency correction system. Is the core content of the full text. The fourth part is "constructing the modern juvenile correction system of our country". The purpose of the modern correction system and the new concept of the modern correction system are expounded from a comparatively scientific point of view. On this basis, it puts forward a series of ways or suggestions to construct the modern correction system for teenagers in our country, such as studying seriously, drawing lessons from the advanced correction system of foreign countries, and seeking the balance point of juvenile interests in "bidirectional protection". To perfect the protection system of juvenile interests in criminal procedure, to bring into the definition of the lower age limit of juvenile correction, to establish the juvenile correctional home and its conservation measures, and to carry out the community correction system. The research methods of this paper are literature method, comparative research method and comprehensive analysis method of some empirical investigations. The breakthrough point is to break the traditional concept of juvenile correction, to explore the shortcomings of the juvenile correction system in China, and to put forward a series of corrective measures, methods and countermeasures with scientific and avant-garde spirit.
