劳动教养制度改革问题研究

【摘要】: 劳动教养制度是我国一项重要的法律制度,但在推进依法治国的进程中,其缺陷日益凸现出来,特别是在我国新《刑法》、《刑事诉讼法》、《行政处罚法》、《立法法》相继颁布实施后,劳动教养制度的合理性、合法性受到了质疑,其存废问题引起了激烈争论。本文试图对我国劳动教养制度的历史演变与发展状况进行回顾和研究,正确分析劳动教养制度中存在的问题并提出相应的改革建议。 全文约五万字,除引言和结语之外,分为三部分,现分述如下: 第一部分:劳动教养制度概述。该部分介绍了我国劳动教养制度的发展沿革和主要内容,客观评价了劳动教养制度50年来取得的历史成就。 第二部分:劳动教养制度存在的具体问题及其价值取向。该部分在客观地分析了现行劳教制度在性质、适用对象、审批程序、期限以及立法等方面存在的问题并对之进行思考的基础上,对劳动教养制度的存废之争进行了评价,分析了其存在的合理性以及改革的必要性,得出必须改革的结论。 第三部分:劳动教养制度改革的构建思路。该部分首先阐述了劳教制度改革应遵循的立法化、司法化、程序化原则;其次对目前理论界提出的行政化、刑罚化、保安处分化等改革模式分别进行了评价;最后通过对劳动教养制度与国外保安处分制度的比较,明确了劳动教养保安处分化的改革方向,在此基础上,对劳动教养制度改革的立法模式和立法名称进行了选择,并提出了改革的具体方案。
[Abstract]:The system of re-education through labor is an important legal system in our country, but in the process of promoting the rule of law, its defects have become increasingly obvious, especially after the promulgation and implementation of the new Criminal Law, the Criminal procedure Law, the Administrative punishment Law and the Legislative Law. The rationality and legality of the system of reeducation through labor have been questioned, and the issue of its retention and abolition has aroused fierce controversy. This paper attempts to review and study the historical evolution and development of the system of re-education through labor in China, correctly analyze the problems existing in the system of re-education through labor and put forward corresponding suggestions for reform. The full text about 50,000 words, in addition to the introduction and conclusion, is divided into three parts, now described as follows: the first part: Overview of the system of re-education through labour. This part introduces the evolution and main contents of the reeducation through labor system in China, and evaluates objectively the historical achievements of the reeducation through labor system in the past 50 years. The second part: the specific problems and value orientation of the system of reeducation through labor. On the basis of objectively analyzing the nature, applicable object, examination and approval procedure, time limit and legislation of the current re-education through labor system, this part evaluates the debate on the retention and abolition of the re-education through labor system. The rationality of its existence and the necessity of reform are analyzed. The third part: the train of thought of the reform of reeducation through labor system. This part firstly expounds the principles of legislation, judicature and procedure that should be followed in the reform of re-education through labour system, and then evaluates the reform models of administrative, penal and security division put forward by the theoretical circle at present. Finally, by comparing the reeducation through labor system with the security measure system of foreign countries, the reform direction of the division of the reeducation through labor security department is clarified, and on this basis, the legislative mode and the legislative name of the reform of the reeducation through labor system are selected. And put forward the concrete plan of reform.
