商业贿赂行为研究

【摘要】: 商业贿赂是不正当竞争行为的一种,它严重破坏了我国的市场经济秩序,损害了消费者的合法权益,也在一定程度上诱导了公职人员的受贿犯罪,已到了非治不可的程度。因此,必须切实采取有效措施,加强对商业贿赂行为的惩治力度。本文从商业贿赂的行为特征入手,分析了商业贿赂给国家和社会带来的严重危害,特别是对我国公平竞争秩序造成的巨大破坏,进而通过深刻剖析商业贿赂行为产生的原因,,提出对它的预防和惩治办法。 全文共分五个部分:第一部分为商业贿赂的特性研究,主要对商业贿赂行为做出科学界定,对其行为主体、贿赂内容、主观心态及隐蔽性和违法性等五个特征进行分析,还将商业贿赂行为与回扣、折扣、俑金、贿赂罪四种相关行为做了认真地比较和严格地区别。第二部分是商业贿赂行为的分类,对其两种类型一商业行贿和商业受贿进行研究。第三部分重点分析了商业贿赂的危害。第四部分是对商业贿赂行为的产生原因的剖析,包括社会根源和个人原因。前者主要有新旧体制转换过程中的矛盾;经济领域中的供需矛盾和商品市场经济的消极作用;思想领域中的错误思潮的影响;执法不严、打击不力等。后者主要有主体法纪观不健全;经营实力不厚,竞争力较小;具有不合理、超常的需要等。第五部分为商业贿赂行为的防治,这一部分是全文的落脚点和归宿,也因此是重点着墨之处。在预防方面,笔者提出五种措施,即深化改革,营造公平竞争的市场环境;改善和强化政府行政管理;完善市场规则系统;完善市场监督机制,加强对企业特别是企业决策者的法律监督;提高企业和企业成员的综合素质。在惩治方面,则采取罚款、没收,责令停产停业、吊销许可证或执照;追究刑事责任等多种措施。
[Abstract]:Commercial bribery is a kind of unfair competition behavior, which seriously damages the order of market economy, damages the legitimate rights and interests of consumers, and induces the bribery crime of public officials to a certain extent. Therefore, we must take effective measures to strengthen the punishment of commercial bribery. Starting with the characteristics of commercial bribery, this paper analyzes the serious harm that commercial bribery brings to the country and society, especially the great damage to the fair competition order of our country, and then analyzes the causes of commercial bribery deeply. Put forward its prevention and punishment. The thesis is divided into five parts: the first part is the research on the characteristics of commercial bribery, which mainly defines the commercial bribery behavior scientifically, analyzes its main body, bribery content, subjective mentality, concealment and illegality. Commercial bribery and kickbacks, discounts, terracotta warriors, bribery crimes are carefully compared and strictly distinguished. The second part is the classification of commercial bribery, the two types of commercial bribery and commercial bribery are studied. The third part analyzes the harm of commercial bribery. The fourth part is the analysis of the causes of commercial bribery, including social and personal causes. The former mainly includes the contradictions in the process of the transformation of the new and the old system, the contradiction between supply and demand in the economic field and the negative role of the commodity market economy, the influence of the wrong ideological trend in the ideological field, the lax enforcement of the law, the weak crackdown, and so on. The latter is mainly subject view of law and discipline is not perfect, management strength is not thick, competitiveness is small, have unreasonable, extraordinary need and so on. The fifth part is the prevention and cure of commercial bribery. In the aspect of prevention, the author puts forward five kinds of measures, that is, deepening the reform, creating a market environment of fair competition, improving and strengthening the government administration, perfecting the system of market rules, perfecting the mechanism of market supervision, We should strengthen the legal supervision over enterprises, especially the decision makers, and improve the comprehensive quality of enterprises and their members. In the aspect of punishment, we should take many measures, such as fine, confiscation, suspension of production and business, revocation of license or license, investigation of criminal responsibility and other measures.
