“西头帮”涉黑案审判风波

【摘要】：2001年底,广西北海市中级人民法院一审认定北海“西头帮”犯罪团伙不属于“具有黑社会性质的犯罪组织”。公诉机关为此提出抗诉。这不但在广西引起强烈反响,还引发了一场在司法实践中如何认定“黑社会性质犯罪组织”的争议。而一审宣判后司法机关及相关执法部门相继挖出的“保护伞”,使得这一案件变得更加复杂。
[Abstract]:At the end of 2001, the Guangxi Beihai Intermediate people's Court found that the "Xitou gang" criminal gang in Beihai did not belong to the "criminal organization with the nature of triad society". The public prosecution organ filed a protest against this. This not only causes strong reactions in Guangxi, but also causes a dispute over how to identify "underworld criminal organizations" in judicial practice. The case became more complicated by the "umbrella" dug up by the judiciary and relevant law enforcement departments one after another after the judgment of the first instance.
