法律视域下的唐代户籍制度研究

【摘要】：户籍制度是中国古代最具特色的一项社会制度,它不仅仅是单一的人口登记,而是与土地、赋役等其他制度相连接的,并且以此来掌握国家的经济发展状况,维护封建国家的统治。它的重要性既体现在是其他制度运行的基本依据,也体现在其作为节点对整个国家体系运行的衔接作用,反应了社会控制和个人权利的相互制衡。我国古代户籍制度萌芽于春秋战国时期,经秦汉,至唐得以完善,时至今日,仍然与我们的生活息息相关。唐代是中国历史上的集大成的时代,户籍制度也非常具有代表性,对其进行研究可以在回顾历史的同时能够展望未来。以法律视角对唐代户籍进行研究,首先要了解并分析其立法,而关于户籍制度的立法主要见于《唐律疏议》以及一些其他法律条文。通过研究相关的法律条文,重点分析唐代户籍制度的基本内容,具体可以分为以下几个方面,户籍的登记:包括登记的程序、内容以及审核;对户籍的管理:包括对特殊身份籍、漏籍以及其他违反户籍管理行为的管理及处罚;以及户籍制度的政治、经济、文化意义。对唐代户籍制度研究主要运用文献研究法、归纳法等方法。通过查阅、收集多部国内外学者的相关文献,较为全面的掌握唐代户籍制度的基本内容;并通过总结归纳唐代户籍制度的运行、管理情况,及其意义,让读者在宏观和具体问题上对于唐代户籍制度都可以有全面深入的认识,在吸取其有利方面的同时指出弊端所在,为今后我国的户籍制度改革提供历史依据和借鉴范本。
[Abstract]:The household registration system is the most characteristic social system in ancient China. It is not only a single population registration, but also connected with other systems, such as land, taxes and so on, and to grasp the economic development of the country. Its importance is not only the basic basis of the operation of other systems, but also the connection of the operation of the whole national system as a node. It reflects the checks and balances between social control and individual rights. The ancient household registration system of our country was sprouted in the Spring and Autumn and warring States period and was perfected by the Qin and Han dynasties to the Tang Dynasty until now. The Tang Dynasty was an era of great success in Chinese history, and the household registration system was also very representative. To study it, we can look forward to the future while looking back the history. In order to study the household registration in Tang Dynasty from the perspective of law, we should first understand and analyze its legislation. The legislation on the household registration system is mainly found in the Tang Law and some other legal provisions. Through the study of the relevant legal provisions, the basic content of the household registration system in the Tang Dynasty is analyzed. Specific can be divided into the following aspects, the registration of household registration: including registration procedures, content and audit; Management of household registration: including the management and punishment of special status, missing registration and other violations of household registration management; As well as the political, economic, cultural significance of the household registration system. The study of the household registration system in the Tang Dynasty mainly used the method of literature research, induction and other methods. Through consulting, collect a number of domestic and foreign scholars related literature. Master the basic contents of the household registration system in Tang Dynasty; And through summing up the operation, management, and significance of the household registration system in the Tang Dynasty, let readers have a comprehensive and in-depth understanding of the household registration system in the Tang Dynasty on both macro and specific issues. At the same time, it points out the disadvantages and provides the historical basis and model for the future reform of the household registration system in China.
