我国农村留守儿童监护制度的反思与完善

【摘要】：随着城乡二元经济结构的形成,农村剩余劳动力向城市大量转移,受城乡二元户籍制度的影响产生了农村留守儿童这一社会群体。农村留守儿童属于未成年人中的一类特殊群体,父母监护的缺失和代管监护的不规范,使农村留守儿童面临着心理、教育、道德、人身安全等方面的困境。因此,解决农村留守儿童问题的关键就在于解决农村留守儿童监护问题。近年来,城乡经济差距的拉大驱使着农民进城务工,农村留守儿童数量日益增多,农村留守儿童监护问题也日益突出。我国立法上对农村留守儿童利益的保护缺少专门的法律规范。在具体实践中,有关涉及农村留守儿童问题的解决所适用的是未成年人监护制度方面的法律规定,因其缺乏针对性,未能很好的解决当前农村留守儿童的监护缺失问题。农村留守儿童监护不仅影响着儿童的身心健康发展,也关系着社会的和谐稳定和民族的未来。为有效解决当前农村留守儿童监护中存在的问题和利益受损的现状,本文以未成年人监护制度为视角,立足于我国现行立法,运用法学专业知识对农村留守儿童监护制度进行深层次的分析,提出具有可行性的完善建议。本文主要分为三大部分：第一部分农村留守儿童监护概述。笔者首先确定了农村留守儿童的概念,进而明确了农村留守儿童监护的内涵,并进一步就其监护的必要性进行了阐述。第二部分我国农村留守儿童监护模式和引发的问题。首先对当前我国农村留守儿童的监护模式进行了考察,其次对农村留守儿童监护产生的问题进行详细陈述,最后从法律的角度阐述了农村留守儿童的权利受损情况。第三部分我国农村留守儿童监护制度的立法现状及其制度完善。该部分首先就目前未成年人监护制度的立法现状予以介绍,进而指出未成年人监护制度的缺陷,最后提出完善农村留守儿童监护制度的建议。
[Abstract]:With the formation of urban-rural dual economic structure, rural surplus labor force has been transferred to cities in large quantities. Under the influence of the dual household registration system in urban and rural areas, rural left-behind children are a social group. Rural left-behind children belong to a special group of minors, the absence of parental custody and the non-standard custody of escrow. Rural left-behind children are faced with psychological, educational, moral, personal security and other difficulties. Therefore, the key to solve the problem of rural left-behind children lies in solving the problem of rural left-behind children's guardianship. In recent years, The widening economic gap between urban and rural areas is driving farmers to work in cities, and the number of children left behind in rural areas is increasing day by day. The problem of rural left-behind children's guardianship is also increasingly prominent. In our country's legislation, the protection of the interests of rural left-behind children is lack of special legal norms. The legal provisions relating to the system of guardianship of minors applied to the problem of children left behind in rural areas because of their lack of pertinence, The lack of custody of children left behind in rural areas is not only affecting the development of children's physical and mental health, but also affecting the development of children's physical and mental health. It is also related to the social harmony and stability and the future of the nation. In order to effectively solve the problems existing in the current rural left-behind children's guardianship and the current situation of damaged interests, this paper, from the perspective of the guardianship system of minors, is based on the current legislation of our country. This paper makes a deep analysis of the guardianship system of left-behind children in rural areas by means of the specialized knowledge of law. This paper is divided into three parts: the first part is an overview of rural left-behind children. Firstly, the author defines the concept of rural left-behind children, and then clarifies the connotation of rural left-behind children guardianship. The second part of the second part of China's rural left-behind children guardianship model and the resulting problems. First of all, the current rural left-behind children's guardianship model has been investigated. Secondly, the problems arising from the custody of left-behind children in rural areas are described in detail. The third part is the legislative status and perfection of the rural left-behind children's guardianship system in China. The first part of this part is about the current status of the minors' guardianship system. The status of legislation is introduced, Then it points out the defects of the guardianship system of minors, and finally puts forward some suggestions to perfect the guardianship system of children left behind in rural areas.
