县级政府重大行政决策中公众参与行为优化研究

【摘要】：公众参与是公众为诉求和实现公共利益,通过多种合法途径,参与到政府公共决策中去,并在决策制定中充分表达公众意见,影响公共决策的行为过程。公众有效参与到政府重大行政决策中来,不仅可以代表群众表达最直接的诉求和意愿,而且还大大降低了政府行政风险以及政府运作成本,最终也提高了政府工作效率。县级政府处于城市和乡村经济社会、文化政治、生态环境的中间环节,其治理服务的对象具有分散广、成分复杂、发展不均等特征,起着国家宏观经济落实为微观经济的中介作用,是辖区内经济社会发展的决策机构,它直接面向基层,是贯彻落实党和国家政策的一级关键职能部门。而且县级政府在与公众的互动具直接性,容易实现实质性公众参与,体现公众的利益诉求,因此做好县级政府重大行政决策中的公众参与工作,可以说是一项加快社会治理,构建和谐社会的基础性工作。本文在分析政府信息公开落实不到位、官本位思想依然存在、公众参与决策的途径不畅等问题的基础上,提出进一步完善信息公开立法、加强重大行政决策信息公开的制度实践、建立协商民主决策制度、建立政府决策公开制度、规范政府公共决策程序、完善政府决策责任制度等措施,并对公众参与下县级政府作出的重大行政决策的决策范围和决策程序提出了优化建议。
[Abstract]:Public participation is the public's pursuit and realization of the public interest, through a variety of legal means, to participate in the government's public decision-making, and to fully express public opinions in decision-making. The effective participation of the public in the major administrative decisions of the government can not only express the most direct demands and wishes on behalf of the masses, but also greatly reduce the administrative risks of the government and the operating costs of the government. The county level government is in the middle of the city and rural economy, society, culture and politics, and ecological environment. The object of its governance and service has the characteristics of wide dispersion, complex composition and uneven development. It plays an intermediary role in the implementation of the state's macro-economy as a micro-economy, and is a decision-making body for economic and social development within the jurisdiction, which is directly oriented towards the grass-roots level. It is a key functional department at the first level to implement party and state policies. Moreover, county-level governments have a direct interaction with the public, which is easy to realize substantive public participation and reflect the interests of the public. Therefore, doing well the public participation in the major administrative decisions of county governments is a basic work to speed up social governance and build a harmonious society. On the basis of the problem that the way of public participation in decision-making is not smooth, it is proposed that the legislation on information disclosure should be further improved, the system practice of information disclosure of major administrative decisions should be strengthened, the system of consultation and democratic decision-making should be established, and the open system of government decision making should be established. Some measures, such as standardizing the government's public decision-making procedure and perfecting the responsibility system of government's decision-making, are put forward, and some suggestions are put forward to optimize the decision scope and decision-making procedure of the important administrative decision made by the county-level government under the participation of the public.
