中国海外公民领事保护的发展研究

【摘要】：随着我国综合国力和经济实力的增强,在海外的中国公民人数不断的增加。从改革开放到加入世贸组织,再到“一带一路”,中国走出去的步伐不断地加快和深入。但现在全球安全局势复杂,中国要想安全的走出去,要想中国的公民安全的行走在世界的每一个角落,就必须加快发展领事保护。现阶段关于领事保护的研究已经开始铺展开来,但这一领域在国内而言还尚属于一个较为崭新的领域。加快对这一问题的研究将会对中国未来成为全球性有影响力大国的目标形成保障。首先,本文从领事保护制度的研究开始,通过探究领事保护制度的历史发展,特别是国际法和国际制度中关于领事保护的界定,为更精确地定义领事保护奠定前提。接下来通过研究目前美国、英国、中国等国家官方文本、材料中提及的关于领事保护的相关规定,为本文对领事保护概念的界定提供更加广阔的坐标轴。在上述研究的基础上,结合各国学者的诸多观点带来的启发以及本文作者的个人思考,抽象出领事保护的概念。其次,从历史研究的角度探讨中国领事保护发展的三个阶段及其发展的原因分析,为更深层次的探讨中国领事保护发展的影响因子和发展路径提供历史经验。从新中国成为初期到1978年是中国海外公民领事保护从逐渐展开到陷入停滞的阶段。从1978年改革开放到2004年,中国海外公民领事保护从停滞进入了快速发展的阶段。这主要表现在领事保护条约的签署、国内法制的完善、领事机构的健全等方面。2004年之后,中国海外公民的领事保护进入了新的发展阶段。再次,主要讨论了结合现阶段的领事保护发展状况,提出当前中国海外公民领事保护发展存在的问题和不足。第四章则是针对当前中国海外公民领事保护中存在的问题,借鉴各国领事保护发展的方式方法和作者的个人思考,对我国的领事保护的发展提出解决办法。
[Abstract]:With the strengthening of China's comprehensive national strength and economic strength, the number of Chinese citizens abroad is constantly increasing. From the reform and opening up to the accession to the World Trade Organization, To Belt and Road, the pace of China's going out has been accelerating and deepening. But now the global security situation is complex. If China wants to go out safely, it wants its citizens to walk safely in every corner of the world. We must speed up the development of consular protection. At this stage, the research on consular protection has begun to spread out. However, this field is still a relatively new one at home. Speeding up research on this issue will guarantee China's goal of becoming a global and influential power in the future. First of all, Starting from the study of consular protection system, this paper explores the historical development of consular protection system, especially the definition of consular protection in international law and international system. To lay the groundwork for a more precise definition of consular protection. Next, by studying the relevant provisions on consular protection currently mentioned in the official texts of the United States, the United Kingdom, China, and other countries, It provides a broader coordinate axis for the definition of the concept of consular protection in this paper. On the basis of the above research, combined with the inspiration of scholars from various countries and the personal thinking of the author of this article, the concept of consular protection is abstracted. Secondly, From the perspective of historical research, this paper probes into the three stages of the development of consular protection in China and the reasons for its development. From the beginning of the new China to 1978, the consular protection of overseas citizens of China gradually expanded to a stage of stagnation. From 1978 to 2004, The consular protection of Chinese overseas citizens has entered a stage of rapid development from stagnation. This is mainly manifested in the signing of consular protection treaties, the perfection of domestic legal system, the integrity of consular institutions, and so on. After 2004, The consular protection of Chinese overseas citizens has entered a new stage of development. Thirdly, the development of consular protection at this stage is mainly discussed. The fourth chapter aims at the problems existing in the development of consular protection of Chinese overseas citizens, and draws lessons from the ways and methods of consular protection development in various countries and the author's personal thinking. To our country's consular protection development proposed the solution.
