论未成年人犯罪国家干预法律理念的更新

【摘要】：我国未成年人犯罪国家干预在理念上没有从未成年人的权利及培养未成年人的法律意识和法律信仰出发,在实践中暴露出很多问题和缺陷。对此,未成年人犯罪国家干预的法律理念更新应从尊重和保障未成年人权利出发,以权利为本位,加强个体自律,使未成年人真正认识到法律不单是惩罚违法犯罪,更是为保障其权利、利于其发展而制定,从而达到使其信仰法律而不是畏惧法律的效果,进而矫正行为,更好地树立正确的世界观、人生观、价值观。
[Abstract]:The state intervention on juvenile delinquency in our country does not start from the rights of minors and the training of legal consciousness and belief of minors, which exposes a lot of problems and defects in practice.In view of this, the renewal of the legal concept of state intervention on juvenile delinquency should start from respecting and protecting the rights of minors, take the right as the standard, strengthen the individual self-discipline, and make the minors realize that the law is not only to punish the illegal crimes.In order to protect their rights and promote their development, it is necessary to make them believe in the law rather than fear the law, and then correct their behavior and set up a correct world outlook, outlook on life and values.
