和谐社会视角下农民政治参与权有序行使研究

【摘要】：改革开放以来,我国在经济、政治、文化等各个方面都有了翻天覆地的变化。特别是在建设和谐社会不断纵深发展的今天,在广大农村地区,随着农村经济的发展,法律、政治、文化教育的普及,农民的主体意识、权利意识得到了加强,其政治心理日渐趋于成熟,参与政治的热情得以提高。但是由于多方面的原因,我国农民政治参与权有序行使的现状并不乐观。这些不仅不利于维护广大农民的政治权益,而且极大地限制了广大农民政治参与权的有序行使,构成了广大农村地区政治不稳定的因素,对国家的稳定繁荣也构成了阻碍。因而本文在构建和谐社会的视角下,通过阐释农民政治参与权有序行使的必要性这一前提,分析当前我国实践中农民政治参与权行使的现状,深入剖析这些现象的内在原因,从而提出对策,保障广大农民政治参与权的有序行使。本文正文主要由四个章节组成。第一章主要是对农民政治参与权及其有序行使的必要性进行概述,分为农民政治参与权相关问题理论界定与和谐社会视角下农民政治参与权有序行使的必要性两个部分。在本章中,通过对农民、政治参与、政治参与权、农民政治参与权等概念进行一一阐释,为文章的后续研究提供理论基础。同时,通过分析农民政治参与权有序行使对于推进民主政治建设、推动和谐社会发展和保障农民的基本权益的重要作用,突出农民政治参与权有序行使的必要性。第二章主要是对实践中农民政治参与权无序行使现状的概括。根据前文中阐明的农民的五类政治参与权,即选举权、知情权、参与权、表达权和监督权,本章中对实践中农民政治参与权无序行使的现象也从这五个方面进行归纳,分别是：农民选举权的不平等问题严重影响农民选举权行使；知悉和行使知情权的途径和方式不完善；参与权行使的方式单一,行使的层级较低范围窄；表达权易受侵害,怠于行使现象严重；监督主体与被监督主体易混同,监督缺乏有效渠道。第三章主要是通过对上一章中农民政治参与权行使无序现状的深入剖析,发掘实践中出现这些现象的根本原因,为下文中提出具体对策提供相关依据。通过层层分析,就农民政治参与权无序行使现状的成因而言,主要包括人大代表选举制度的内在缺陷、村民自治制度不健全、信访制度的不完善这三个方面。第四章主要是以前文中分析得出的农民无序行使政治参与权的原因为依据,为切实保障农民政治参与权的有序行使提出具体的对策,主要是从相关制度入手,针对其现有的问题,一一进行完善,具体包括完善人大代表选举制度、村民自治制度和信访制度。
[Abstract]:Since the reform and opening up, China's economy, politics, culture and other aspects have undergone earth-shaking changes. Especially in the construction of a harmonious society in depth today, in the vast rural areas, with the development of rural economy, law, politics, culture and education, farmers' consciousness of subject and right has been strengthened. Its political psychology tends to mature day by day, the enthusiasm that participates in politics is improved. However, due to various reasons, the status quo of the orderly exercise of farmers' political participation rights is not optimistic. These are not only unfavorable to safeguarding the peasants' political rights and interests, but also greatly restrict the orderly exercise of the peasants' political participation rights, constitute the factors of political instability in the vast rural areas, and hinder the stability and prosperity of the country. Therefore, from the perspective of constructing a harmonious society, this paper analyzes the present situation of the exercise of peasants' political participation right in our country's practice, and analyzes the internal reasons of these phenomena by explaining the necessity of the orderly exercise of peasants' political participation right. Thus puts forward the countermeasure, guarantees the broad peasant political participation right to exercise in an orderly manner. The main body of this paper consists of four chapters. The first chapter mainly summarizes the peasants' political participation right and the necessity of its orderly exercise, which is divided into two parts: the theoretical definition of farmers' political participation right and the necessity of orderly exercise of peasants' political participation right from the perspective of harmonious society. In this chapter, the concepts of farmers, political participation rights and farmers' political participation rights are explained one by one to provide a theoretical basis for the follow-up study of the article. At the same time, by analyzing the important role of the orderly exercise of peasants' political participation right in promoting the construction of democratic politics, promoting the development of harmonious society and safeguarding the peasants' basic rights and interests, the necessity of orderly exercise of peasants' political participation right is highlighted. The second chapter is the summary of the status quo of peasants' political participation right in practice. According to the five types of peasants' political participation rights, namely, the right to vote, the right to know, the right to participate, the right to express and the right to supervise, this chapter also summarizes the phenomenon of the peasants' political participation right exercising disorderly in practice from these five aspects. They are: the inequality of peasants' right to vote seriously affects the exercise of peasants' right to vote; the ways and means of knowing and exercising the right to know are not perfect; the way of exercising the right to participate is single, and the level of exercising the right of participation is narrow, and the right of expression is vulnerable to infringement. The phenomenon of slack in exercise is serious, the subject of supervision is easy to be confused with the subject of supervision, and the supervision lacks effective channels. The third chapter is mainly through the previous chapter of the farmers' political participation in the exercise of the disordered situation of in-depth analysis of the practice of these phenomena to explore the root causes, for the following specific countermeasures to provide relevant basis. Through layer by layer analysis, the causes of the disorderly exercise of peasants' political participation rights mainly include the inherent defects of the election system for deputies to the people's Congress, the imperfect system of villagers' autonomy, and the imperfect system of letters and visits. The fourth chapter is mainly based on the reasons of peasants' disorderly exercise of political participation right, and puts forward concrete countermeasures to ensure the orderly exercise of peasants' political participation right, mainly from the relevant systems. In view of its existing problems, one by one to improve, including the improvement of the election system of deputies to the people's Congress, the villagers autonomy system and the system of letters and visits.
