论专属经济区内的航行自由:法律边界与中国应策

【摘要】：专属经济区内的航行自由研究具有重要的理论和现实意义。其理论争议点涵盖沿海国在其专属经济区内是否拥有对他国船只特别是军用船只的"同意权"问题,以及有关《联合国海洋法公约》和《联合国宪章》对应文本条款的阐释争论。同时,这一问题所引发的实践问题则包括与航行自由相对应的飞越自由问题和专属经济区上空的防空识别区问题、专属经济区内的海洋科学研究问题和沿海国在专属经济区内所享有的剩余权利问题。为此,处理专属经济区内的航行自由问题需要选择适当的法律边界。基于自身海洋安全和发展需要,中国应对此问题持体系化且灵活性的应对策略。
[Abstract]:The study of freedom of navigation in the exclusive economic zone has important theoretical and practical significance. Its theoretical controversy covers the question of whether a coastal State has a "right of consent" over vessels of other States, especially military vessels, within its exclusive economic zone, And the interpretation of the corresponding articles of the UN Convention on the Law of the Sea and the UN Charter. At the same time, the practical issues raised by this question include the freedom of overflight, which corresponds to freedom of navigation, and the question of the air defence identification zone over the exclusive economic zone, The issue of marine scientific research in the exclusive economic zone and the residual rights enjoyed by coastal States within the exclusive economic zone. Therefore, to deal with freedom of navigation in the exclusive economic zone requires the choice of appropriate legal boundaries. In view of its own maritime security and development needs, China should adopt a systematic and flexible strategy to deal with this problem.
