邻避设施建设中的公民参与研究

【摘要】：随着我国城市化进程的不断改革深化,各个城市为了满足大众生活的日常所需以及城市自身内部系统的发展,兴建了一些我们经常在日常生活中可以看到的:诸如垃圾填埋场、监狱、精神病院、垃圾焚烧厂、核电站、变电站等这类公共设施,这些公共设施的效益被整个社会公民共同享用,但是它所带来的危害却被居住在其附近的居民独自承担。因为邻避设施具有明显的负外部性,政府在建设邻避设施时会被居住在其附近居民激烈反对,甚至产生邻避群体性事件,所以政府对邻避设施进行决策时引进公民参与机制对于解决邻避困境是非常有效的一种途径。有效的公民参与能够保障在邻避设施建设过程中公民的利益不受到侵害,并且促使政府作出更加符合实际的科学决策。建立一个与公民良好互动的合作机制,这也是新公共服务理论对于当代服务型政府的最基本要求。本篇论文正是基于以上的环境背景对我国公民参与政府邻避项目的建设现状和存在的问题进行研究和探索,本文主要通过分析我国典型的邻避设施案例—广州番禹案例,并且以对西安市公民参与邻避设施建设的实际调查情况为依据,在新公共服务理论和信息不对称理论的指导上,分析我国目前公民参与邻避设施建设时的现状以及存在的问题,并从政府、公民、社会三个方面分别探讨造成我国邻避设施建设中公民参与困境的问题之根源,在结合我国民主政治发展的理论要求和我国实际情况的基础上,从发挥政府对公民参与的引导作用、公民在邻避设施决策中的主导作用、社会对公民参与的协调作用这三个方面来解决我国目前公民参与邻避设施建设存在的困境,使公民参与合法化和常态化。这样一来不仅改善了我国政府与公民的关系,提高了政府的公信力,也保障了公民基本的参与权力,促进了我国民主政治的发展。
[Abstract]:With the deepening of the urbanization process in our country, in order to meet the daily needs of the public and the development of the city's own internal system, cities have built some things that we can often see in our daily life, such as landfill sites. Public facilities such as prisons, mental hospitals, waste incinerators, nuclear power plants, substations, and so on, whose benefits are shared by the entire community, but whose harms are borne by residents living nearby. Because of the obvious negative externalities of the adjacent shelter facilities, the government will be strongly opposed by the residents living near them when building the adjacent facilities, and even produce neighborhood avoidance incidents. Therefore, it is a very effective way for the government to introduce citizen participation mechanism to solve the problem of neighborhood avoidance. Effective citizen participation can ensure that the interests of citizens are not infringed in the process of construction of adjacent facilities, and promote the government to make more realistic scientific decisions. The establishment of a cooperative mechanism of good interaction with citizens is also the most basic requirement of the new public service theory for the modern service-oriented government. This paper is based on the above environmental background to study and explore the current situation and existing problems of citizens' participation in the construction of government adjacent avoidance projects. This paper mainly through the analysis of the typical case of adjacent facilities in China-the case of Yangyu in Guangzhou. On the basis of the investigation of citizens' participation in the construction of adjacent facilities in Xi'an, and under the guidance of the new public service theory and the theory of asymmetric information, this paper analyzes the present situation and existing problems of citizens' participation in the construction of adjacent facilities in China. And from the three aspects of government, citizen and society, this paper probes into the root of the problem of citizen participation in the construction of adjacent facilities in our country, on the basis of combining the theoretical requirements of the development of democratic politics in our country and the actual situation of our country. From the following three aspects: giving full play to the guiding role of the government to citizen participation, the leading role of citizens in the decision-making of adjacent facilities, and the coordinating role of society on citizen participation, the difficulties of citizens participating in the construction of adjacent facilities in our country are solved. To legalize and normalize citizen participation. This not only improves the relationship between our government and citizens, enhances the credibility of the government, but also guarantees the basic participation power of citizens, and promotes the development of democratic politics in our country.
