法治社会视域下养老责任研究

【摘要】：养老问题是关乎家庭与社会和谐的大事。在法治语境下,厘清养老责任,构建新型养老模式,是法治社会建设的重要议题。文章绪论部分主要介绍了当前我国养老问题的现状,并通过对目前国内外有关养老问题研究情况的具体介绍和分析,提出本文写作的基本思路、角度和方法,指出法治社会养老问题的出路在于多方力量参与到养老中,重新构建一种以家庭为核心的新型养老模式。文章第二部分主要介绍了本文写作的理论依据,通过对社会权的概念、历史渊源、马克思主义关于社会权的基本观点、法治社会中社会权基本内容的介绍,提出社会权利具有国家性和相对性,公民社会权利的保障需要国家和非国家行为体共同努力。文章第三部分主要介绍了我国传统社会家庭养老的原因、基本内容以及面临的问题。家庭承担养老责任,是我国赡养老人的传统方式,它不但节省了国家的养老资源,维护了社会安定,同时也满足了老年人的精神需求。但是在社会权兴起的状态下,国家和社会需亦应分担部分养老责任。文章第四部分主要介绍随着经济的发展、历史的变迁和社会的进步,在法治社会视域下,家庭养老责任观念应当被赋予新内涵,养老并不能全靠家庭,国家和社会也应充分发挥其应有的养老功能。同时,详细介绍了国家、社会和家庭所各自承担的具体养老义务。文章第五部分主要通过分析国外优秀养老经验,从国外对同一问题的不同解决方法入手,对不同国家的养老模式、养老制度进行介绍和对比,扬长避短,并结合中国的实际国情对其加以借鉴吸收,进而为我国法治社会中多元养老责任的实现提供一些良性建议。文章最后一部分基于上述几章的具体介绍分析,指出法治社会下,要破解困扰我国已久的养老难题,就必须对症下药,落实国家、社会和家庭各自承担的具体养老义务,并提出重建以家庭为核心的新型养老模式的一些具体对策和措施。
[Abstract]:The problem of supporting the aged is a major event related to the harmony between family and society. In the context of the rule of law, it is an important issue to clarify the responsibility for the aged and to construct a new mode for the aged. The introduction part of the article mainly introduces the current situation of the old-age problem in China, and through the specific introduction and analysis of the current research situation of the old-age problem at home and abroad, puts forward the basic ideas, angles and methods of the writing of this article. It is pointed out that the way out for the old-age problem in the society ruled by law lies in the participation of various forces in the old-age care and the reconstruction of a new old-age model with family as the core. The second part of the article mainly introduces the theoretical basis of this article, through the concept of social rights, historical origin, Marxist basic views on social rights, the basic content of social rights in a society ruled by law. The author points out that social rights are national and relative, and the protection of civil social rights needs the joint efforts of state and non-state actors. The third part mainly introduces the causes, basic contents and problems of the family pension in the traditional society of our country. It is the traditional way to support the elderly in our country. It not only saves the country's endowment resources, maintains the social stability, but also meets the spiritual needs of the elderly. However, in the state of social rights rising, the state and society should also share part of the pension responsibility. The fourth part of the article mainly introduces that with the development of economy, the change of history and the progress of society, the concept of family responsibility for the aged should be endowed with new connotations under the view of the society ruled by law, and the old-age support is not entirely dependent on the family. The state and society should also give full play to their proper pension function. At the same time, the state, the society and the family respectively bear the specific endowment obligations. The fifth part of the article mainly through the analysis of foreign excellent pension experience, starting from the same problem of different solutions abroad, the pension model and pension system in different countries are introduced and compared to promote strengths and circumvent weaknesses. Combined with the actual situation of China to draw lessons from the absorption, and then for the rule of law society in China to achieve the realization of multiple responsibilities for the elderly to provide some sound suggestions. In the last part of the article, based on the specific introduction and analysis of the above chapters, it is pointed out that in order to solve the problem of supporting the aged which has been puzzling our country for a long time, we must take the right medicine to implement the specific obligation of the state, the society and the family to provide for the aged. And put forward some concrete countermeasures and measures to rebuild the new pension model with family as the core.
