城市规划中公众参与代表遴选研究

【摘要】：近40年的改革开放,促成了中国经济的腾飞,伴随着经济腾飞的则是公民民主意识和维护自身利益的意识不断增强,而这些表现在政治层面就是对政治参与的渴望以及对行政独断的厌恶,公众参与行政活动的积极性不断提高,迫切希望通过合法途径参与到行政活动中来,以表达和维护自身的合法权益。与此同时,中国城市化进程加速推进,公民参与到城市规划中的热情不断高涨,而公众代表遴选作为城市规划领域公众参与的一种程序性的保障机制,对其进行研究有着重要的理论和现实意义。公众代表遴选作为城市规划领域公众参与的重要一环,符合党的十八大提出的增强公众参与的民主政治和社会管理理念。然而基于我国现行法律法规、参与途径以及代表遴选模式等情况,我国城市规划领域的公众代表遴选还存在着诸多问题,一方面降低了公众对于遴选结果的满意度,与公众日益高涨的参与热情和维权意识相去甚远,另一方面也与党中央提出的扩大公众参与,完善社会治理的要求不符。公众代表遴选作为城市规划领域公众参与的一种必然存在,是解决发展矛盾、回应公众诉求的最直接、最有效的手段。本文以公共选择理论、多元主义规划选择理论以及参与阶梯理论为支撑,分析了我国城市规划领域公众代表遴选的必要性,纵观各地城市规划中的公众代表遴选实践,深入剖析了目前我国城市规划中公众代表遴选存在的问题及背后原因,并从完善法律规范、公众组织化参与、遴选信息公开、强化公众监督等角度提出了探索性的建议。最后,通过本文的研究分析得出相关结论。
[Abstract]:The nearly 40 years of reform and opening up have contributed to the rapid development of China's economy, accompanied by a growing sense of democracy and self-interest among citizens. At the political level, these are the desire for political participation and the aversion to administrative arbitrariness. The enthusiasm of the public for participating in administrative activities is constantly increasing, and they are eager to participate in administrative activities through legal channels. To express and protect their legitimate rights and interests. At the same time, the process of urbanization in China is accelerating, and the enthusiasm of citizens to participate in urban planning is rising, and the selection of public representatives is a procedural guarantee mechanism for public participation in the field of urban planning. It has important theoretical and practical significance to study it. As an important part of public participation in the field of urban planning, the selection of public representatives accords with the democratic political and social management concept of enhancing public participation put forward by the 18th National Congress of the CPC. However, based on the current laws and regulations of our country, the way of participation and the mode of representative selection, there are still many problems in the selection of public representatives in the field of urban planning in China. On the one hand, it reduces the public's satisfaction with the selection results. It is far from the increasing enthusiasm of public participation and awareness of safeguarding rights. On the other hand, it is not in accordance with the request of the CPC Central Committee to expand public participation and improve social governance. As an inevitable existence of public participation in the field of urban planning, public representative selection is the most direct and effective means to solve the contradiction of development and respond to the demands of the public. Supported by the theory of public choice, the theory of plural planning and the theory of participation ladder, this paper analyzes the necessity of the selection of public representatives in the field of urban planning in China. This paper deeply analyzes the problems existing in the selection of public representatives in urban planning in our country and the reasons behind them, and puts forward some exploratory suggestions from the angles of perfecting the legal norms, organizing the participation of the public, publicizing the selection information, strengthening the public supervision, and so on. Finally, through the research and analysis of this paper, the relevant conclusions are obtained.
