传统社会的土地权力:正当性支配及其“异化”

【摘要】：传统中国的统治者试图建构一套关于土地权力支配的正当性结构,然而这种正当性建构的努力却总是无法阻止土地权力的扩张与"异化"。这种"异化"具体表现为官方的"苛捐杂税征用无度"以及由此映射到民间之后有权者"大肆兼并"与无权者"以田多为累"的对立统一。从根本上讲,土地权力的"异化"是传统社会权制逻辑下的必然现象,而其匡正与消弭则寓于国家治理从传统向现代的整体转换当中。
[Abstract]:The rulers of traditional China try to construct a set of legitimate structure about the domination of land power, but the efforts of this kind of legitimacy construction can never stop the expansion and "alienation" of land power. This kind of "alienation" is embodied in the official "exorbitant tax expropriation" and the unity of opposites of "wantonly merger" and "tiredness" between the powerful and the powerless after it is mapped to the private people. Fundamentally speaking, the "alienation" of land power is an inevitable phenomenon under the logic of traditional social power system, and its correction and elimination lie in the overall transformation of national governance from traditional to modern.
