宪政是西方资本主义政治发展的产物,到了近代中国才开始接触,对于宪政的认识,中外学者存在差异。西方学者重在有限政府和权力制衡,而中国学界强调保障权利和民主法治。中国共产党在执政实践中,逐步由受中国传统思想文化影响的人治理念向借鉴西方宪政文明的社会主义法治理念转变。中国共产党在中国革命、建设和革新的不同历史时期,经过三代中央领导集体和新一代中央领导集体的执政实践,对社会主义执政理念进行了艰苦的探索,在继承马列主义关于无产阶级政党执政理念的基础上,批判地吸收和借鉴西方资产阶级政党执政理念的有益成分,同时借鉴苏共执政经验与教训,并结合中国的具体实际,发展和创新着社会主义执政理念,使党的执政理念经历着历史的演进,取得了重大发展,形成了中国特色社会主义执政理念,如人民群众主体的理念,全心全意为人民服务的理念,科学执政、民主执政、依法执政等理念,这些理念紧紧围绕着“靠谁执政”、“怎样执政”和“为谁执政”这个中心展开,已具有鲜明的社会主义民主宪政的价值取向,体现了宪政价值中的人民主权原则、保障人权原则和法治原则等,使党的执政获得了巩固的理论基础、充分的政治保障和广泛的群众支持和拥护。又在同其它社会主义国家共产党执政理念的比较中得到重要启迪,总结了成功与失败的经验与教训,从而巩固和加强了社会主义的执政理念。中共这些执政理念,丰富了社会主义民主理论、赋予了党的宗旨新的内涵和完善了社会主义的法治理论,从而推动了社会主义民主政治理论的发展。中国共产党在这些执政理念的指导下,不断完善人民代表大会制度和多党合作与政治协商制度,推进了社会主义民主政治建设;执政中坚持做到“情为民所系、权为民所用、利为民所谋”,显示出为民执政的本质和保障人权的宪政原则;强调依法治国与科学执政、民主执政和依法执政的理念,不断完善和发展社会主义法治;同时革新和完善党的领导,使党的领导逐步走向科学化、民主化和法治化,从而极大地推动了我国民主政治和宪政建设,闪烁着社会主义宪政思想的光芒。
