        实现社会和谐，始终是人类自古以来孜孜以求的一个社会理想。继党的十五大提出“建设社会主义法治国家”后，党的十六届四中全会又提出了“构建社会主义和谐社会”的新命题。所谓社会主义和谐社会，主要是指一种美好的社会状态和社会理想，即全体人民各尽其能、各得其所而又和谐相处的社会，涵盖了人与人、人与社会、人与自然这三方面的辩证关系。这一新的执政理念和方略，是我们党坚持中国特色社会主义道路、用发展着的马克思主义指导新的社会实践的重大成果，也是中国共产党执政理念的重要升华，更是我们党解决发展困境、应对时代挑战的重大战略举措。 中共中央总书记胡锦涛同志深刻指出，我们所要建设的社会主义和谐社会，应该是民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会。胡锦涛总书记之所以把“民主法治”放在六大特征之首，是因为不仅和谐社会必然是民主社会、法治社会，而且只有在一个崇尚民主、奉行法治的社会，构建和谐社会的其它要素才能得到真正实现。从这个意义上讲，和谐社会的所有问题都必然归结于法治问题，或者与法治密不可分，法治在构建和谐社会中具有至关重要的基础性作用，因而必须依靠法治来推动和谐社会的构建，，依靠法治来引导和谐社会的发展，依靠法治来保障和谐社会的实现。 法治，即法律之治，是任何文明社会的基石和保障，更是实现和谐主张的必然要求。换言之，法律本身就是追求社会和谐的产物，和谐社会的性质内在地包含着对于法治的要求，和谐社会是在法治基础上实现的更高的社会发展阶段。就我国当下的情形而言，只有努力探索法治视野下构建和谐社会的基本路径，切实筑牢法治基础，积极推动法治国家建设，才能从根本上实现构建社会主义和谐社会的目标。为此，必须筑牢民主的法治基础，筑牢尊重和保障权利和人权的法治基础，筑牢激发活力和创造精神的法治基础，筑牢公正合理协调利益的法治基础，筑牢确保社会信用的法治基础，筑牢人与自然和谐发展的法治基础，筑牢舆论导向和监督的法治基础，筑牢反腐倡廉的法治基础，筑牢定分止争、化解纠纷的法治基础，筑牢和谐世界的法治基础。

    It is a social ideal for many people to realize harmonious society. After proposing "the construction socialism country under the rule of law", the Communist Party of China, by the huge political wisdom and the theory courage, also proposed in party’s 16 sessions of Fourth Plenary Session "constructs the socialism harmonious society". The so-called socialism harmonious society mainly refers to one kind of happy social condition and social ideal, namely all people can take their proper place in the society. It has covered three aspects dialectical relations, that is to say, the human and the human, the human and social, the human and the nature. This new ruling idea is our party’s invention which has been persisting in the Chinese characteristic socialist road, also is significant strategic action to solve the development difficult position and deal time challenge.Central Committee of the CCP General Secretary Comrade Hu Jintao profoundly pointed out, what is we are constructing the socialism harmonious society should be the democratic rule of law, the fair justice, the good faith, the full of the energy, the stable and order, the human and the nature harmoniously is together. In here, "the democratic government by law" has been placed the first place, this is because, not only the harmonious society is inevitably the democratic society, the rule of law society, moreover only in a society which is democratic and being ruling of law, other essential factors which being used to construct harmonious social be able to be obtained.
