【摘要】：随着时代的发展,新生代农民工逐渐取代老一代农民工在劳动力市场的地位,成为我国劳动力市场的主力军,为我国的城市建设和经济发展做出重大的贡献。同时,新生代农民工在逐渐发展壮大的过程中也显现了大量的问题,有关他们权益保障的问题也成为全国人民关注的重点。新生代农民工有他们自身的特点,比如,受教育程度较高,思维活跃,接受新事物的能力远远强与第一代农民工,他们关心政治,关心自身的发展,维权意识也大大增强。在现实生活中,新生代农民工的就业权、劳动报酬权、休息休假权等合法权利却没有得到足够的重视,很容易受到侵害,并且与城市居民所享有的福利相比有巨大的差异。究其原因,不仅有国家政策滞后的原因,更重要的是法律没有给予他们应有的保障,同时新生代农民工自身法制意识薄弱也对他们自身权益的保障非常不利。因此,我们需要针对新生代农民工群体的特点,在现行法律的基础上,深入讨论研究,弥补现行法律的空白和缺陷,对我国新生代农民工权益保障提出完善的建议,以便更好的维护他们的合法权益,进而更大的推动和谐社会的进步和国家经济的发展。本文具体研究内容主要包括五部分:第一部分,主要对新生代农民工的概念作出界定,概括这一特殊群体的特征,从新生代农民工的产生和发展出发,深入了解新生代农民工的基本状况。第二部分,因新生代农民工权益保障问题的法律制度主要体现在社会保障层面,因此对我国新生代农民工的社会保障制度理论做出系统的阐述,明确我国社会保障人权理念、公平理念、法治理念在新生代农民工社会保障中的体现。第三部分,对新生代农民工权益保障的现状进行剖析,明确目前对新生代农民工保障的问题所在。第四部分通过对新生代农民工权益遭受侵害的原因加以分析,从根本上寻求解决问题的切入点。第五部分,对我国新生代农民工权益保障完善提出建议。通过对现有法律法规进一步完善和政策的改革提出相应建议,使新生代农民工今后能够得到更好的保障。
[Abstract]:With the development of the times, the new generation of migrant workers gradually replace the position of the older generation of migrant workers in the labor market, and become the main force of our country's labor market. At the same time, the new generation of migrant workers in the process of gradual development and expansion has also revealed a large number of problems. The new generation of migrant workers have their own characteristics, such as higher education level, active thinking. The ability to accept new things is far stronger than the first generation of migrant workers, they care about politics, care for their own development, the awareness of rights is also greatly enhanced. In real life, the new generation of migrant workers' right to employment, labor compensation rights. The right to rest and leave and other legal rights have not been paid enough attention, it is easy to be infringed, and compared with the welfare of urban residents, there is a huge difference. What is more important is that the law does not give them due protection, and the weak legal consciousness of the new generation of migrant workers is also very disadvantageous to their own rights and interests. We need to focus on the characteristics of the new generation of migrant workers, on the basis of the existing laws, in-depth discussion and research, to make up for the gaps and shortcomings of the existing laws, and to improve the protection of the rights and interests of the new generation of migrant workers in China. In order to better protect their legitimate rights and interests, and then promote the progress of a harmonious society and the development of national economy. Mainly defines the concept of the new generation of migrant workers, summarizes the characteristics of this special group, starting from the generation and development of the new generation of migrant workers, in-depth understanding of the basic situation of the new generation of migrant workers. Part two. Because the legal system of the protection of the rights and interests of the new generation of migrant workers is mainly reflected in the level of social security, the theory of the social security system of the new generation of migrant workers in China is expounded systematically. Clear the concept of human rights of social security, fair concept, the concept of the rule of law in the new generation of migrant workers in the social security embodied. The third part, the new generation of migrant workers rights and interests of the analysis of the status quo. Clear the current generation of migrant workers security problems. Part 4th through the new generation of migrant workers rights and interests of the analysis of the cause of infringement, from the root to find a solution to the problem. 5th part. Some suggestions are put forward to improve the protection of the rights and interests of the new generation of migrant workers in China. Through the further improvement of the existing laws and regulations and the reform of the policies, the new generation of migrant workers can be better protected in the future.
