残疾老年人法律权益保障制度研究

【摘要】：残疾老年人群体的弱势特征非常明显,经济困难并且对家庭依赖程度高,护理需求巨大,且生活质量较低,通常情况下自我维权意识差。湖南省残疾老年人群体的现状是国内此群体的缩影,经对残疾老年人群体所面临的问题进行法律分析,发现现行残疾老年人的相关法律法规过于笼统,缺乏可操作性,并且司法维权缺少具体程序。法律保障信息不透明,相关监督制度存在缺陷等等。基于寻求解决残疾老年人群相关问题的对策,本文主要采用数据分析及理论分析的方法,从四个部分进行论述:第一部分分析我国残疾老年人权益保障所面临的问题,论述现阶段残疾老年人法律权益保障制度的现状。第二部分主要用相关数据表格阐述湖南残疾老年人法制权益保障所面临现状,剖析在湖南发生的典型案例,并分析现状的成因。第三部分主要研究德国、美国、日本残疾老年人的权益保障法及权益保障制度,探寻这些国家的社会养残养老服务、康复服务、出行及交通服务、福利津贴等方面、完善的权益保障制度以及适合本国国情发展的政策及法律的方法、特点,并思考对我国相关立法及制度政策、制度构建的借鉴。第四部分创新性的为完善我国残疾老年人权益保障的制度建言献策,我国需要建立完善的残疾老年人权益保障制度。首先应建立完善的法律援助制度,降低法律援助门槛,将法律援助范围扩大,加强相关管理工作,促使司法援助制度得到不断完善。其次是建立全面可行的权益保障制度,健全养残制度,社会保险及社会救济、救助制度。现阶段必须完善残疾老年人相关法律文件,完善相关监管部门的工作,使得他们能够在其位办其事,真正做到全方位为残疾老年人服务,从各方面维护他们的权益。
[Abstract]:The vulnerable characteristics of the group of older persons with disabilities are very clear, they are economically difficult and highly dependent on their families, the need for care is enormous and the quality of life is low, The current situation of the disabled elderly group in Hunan Province is the epitome of this group in China. Found that the current laws and regulations of the elderly with disabilities are too general, lack of maneuverability, lack of specific procedures for judicial protection, and lack of transparency in legal protection information, Based on the countermeasures to solve the problems related to the elderly population with disabilities, this paper mainly adopts the methods of data analysis and theoretical analysis. It is discussed from four parts: the first part analyzes the problems faced by the protection of the rights and interests of the disabled elderly in our country. The second part mainly uses the related data table to expound the current situation of the legal rights and interests protection of the disabled elderly people in Hunan Province, and analyzes the typical cases in Hunan Province, and discusses the current situation of the legal rights and interests protection system of the disabled elderly people at the present stage. The third part mainly studies the rights and interests of the elderly with disabilities in Germany, the United States and Japan, and explores the social care and retirement services, rehabilitation services, travel and transportation services in these countries. Welfare allowance and so on, the perfect rights and interests protection system, the policy and the law method, the characteristic which suits the national condition development, and the consideration to our country related legislation and the system policy, 4th part of innovative advice to improve the protection of the rights and interests of the elderly with disabilities, China needs to establish a perfect system of protection of the rights and interests of the elderly with disabilities. First, we should establish a perfect legal aid system. Lowering the threshold of legal aid, expanding the scope of legal aid, strengthening the relevant management work, and promoting the continuous improvement of the judicial aid system. Secondly, it is necessary to establish a comprehensive and feasible system of protection of rights and interests, perfect the system of maintenance of the disabled, social insurance and social relief. At this stage, we must perfect the relevant legal documents of the disabled elderly, perfect the work of the relevant supervision department, so that they can do their work in their own right, so that they can truly serve the disabled elderly in all aspects and safeguard their rights and interests from all aspects.
