城中村改造中村民权益保障研究

【摘要】：“城中村”是我国城乡二元体制背景下形成的一种特殊现象,在经济快速发展和城镇建设规模迅速扩大的背景下逐渐产生。随着城镇化进程的不断加快,在城中村产生的各类问题屡见不鲜,主要表现在城市的规划治理、安全稳定和环境卫生、居民的就业劳动和社会保障等诸多方面,引起了社会各界的广泛关注。2014年3月,李克强总理在政府工作报告中明确指出,要改造1亿人居住的城镇棚户区和城中村,做到城镇规划管理创新和机制建设一体发展,把城中村改造作为政府工作的重心之一。因此,“城中村”改造势在必行。但是,城中村与城市固有的巨大差异使改造中的问题层出不穷,从各地城中村改造实践来看,在改造过程中主要焦点问题之一就是村民的权益保障问题。在大多数乡村地区,土地是村民们赖以生存的生产生活资料。如果失去了土地,村民们在其合法权益得不到有效保障的情况下,很难适应城市生活。当下,各地的城中村改造如火如荼的进行,但损害村民权益的事件时有发生,因此研究改造过程中村民的权益保障问题,对以后的城中村改造乃至整个社会都具有重要的现实意义。本文选取武汉市姚家岭改造实例,介绍其拆迁改造的具体情况,找出城中村改造中村民权益受到损害的原因。同时借鉴国内部分城市城中村改造的成功经验,尝试提出完善村民权益的基本措施,以期对城中村改造中村民权益保障工作的顺利展开有所裨益。本文具体分为六个部分,除去引言和结语外,涉及的主要内容如下:第一部分,城中村改造及案例分析。首先概述城中村的基础问题分析,包括城中村的定义、特征及改造背景。然后选取武汉市姚家岭城中村改造实例,简要介绍姚家岭改造的具体情况,并提出在改造中要重点关注村民的权益损害问题。第二部分,城中村改造中村民权益问题分析。首先介绍改造中村民受到的权益损害,主要包括经济权益、社会权益、政治权益和文化权益。其次分析改造过程中政府、开发商和村民三方利益相关者的责任。最后阐述城中村改造对村民权益造成损害的原因,包括立法体制不健全、补偿机制不合理和社会监督不到位等。第三部分,部分城市城中村改造村民权益保障措施经验借鉴。本文选取的四个城市为广州、深圳、郑州和天津,这些城市在改造过程中存在的问题和姚家岭有一定的相似之处,在联系当地改造实际的基础上提出一些建设性的解决办法,如,充分调动村民参与改造的积极性、处理好村民的现实利益与最终出路、妥善解决村民的就业及社会保障等,为以后城中村改造提供了很好的借鉴作用。第四部分,城中村改造中村民的权益保障措施。从武汉市姚家岭改造项目入手,借鉴其他城市改造模式的成功经验,并提出改造中对村民权益保障的几点建议性措施,对应前文提出的村民权益受到损害的原因,希望为以后的城中村改造提供有益参考。

This paper selects the example yaojialing transformation of Wuhan City, the demolition and renovation of concrete to find out the reasons, to protect the interests of the villagers villages in the transformation of the damage. At the same time, learn from the successful experience of transformation of city village in China, tries to put forward to improve the village people's rights and interests The basic measures to smooth expansion of the villagers of village in city reconstruction work to protect the rights and interests of China.
