日本介护保险法律制度借鉴研究

【摘要】：随着人口老龄化问题加重,老年人的护理逐渐成为困扰着高龄化国家的问题,尤其是对于世界上超高龄社会化典型代表的日本。为了应对日益严重的养老问题,日本率先在亚洲国家中以立法形式来建立老年人护理保险制度。尽管与西方发达国家相比,日本的制度有诸多不足,可是因其属于亚洲国家,与中国国情有着更高的相似性,这种东方文化特色方面的共同性使得日本模式更值得我们借鉴研究。日本的老年人护理制度始于20世纪60年代,从最初的《老人福祉法》、《老人保健法》等等法律的颁布及改进,都不断地完善着日本老年人的护理政策。即便这样,日本的老龄化问题所引发的各种社会问题依然层出不穷,为此,日本对传统的社会保障制度进行了改革,于2000年颁布了《介护保险法》,并在颁布后不断地进行了改革和完善,让日本社会的老年人保障体系朝着经济支持与服务保障相辅相成的方向发展。本文主要通过对相关政策、法律制度的查阅及国内外学者书籍、文章的研究,在日本介护保险法律制度研究的基础上,对这一法律制度的形成背景、运营模式、改革发展等等进行分析,总结出该制度的特点及可行性,从而给我国建立老年人长期护理保险制度设计提供启示性的参考。
[Abstract]:With the aggravation of the aging population, the nursing of the elderly has gradually become a problem for the aging countries, especially for Japan, which is the typical representative of the socialization of the super old people in the world.In order to cope with the increasingly serious pension problem, Japan has taken the lead in establishing an old-age care insurance system in Asian countries by way of legislation.Although compared with the developed countries in the West, Japan's system has many shortcomings, but because it belongs to Asian countries, it has a higher similarity with China's national conditions.This kind of oriental cultural characteristics makes the Japanese model more worthy of our study.The nursing system for the elderly in Japan began in the 1960s. From the promulgation and improvement of the original Law on the Welfare of the elderly, the Law on Health Care for the elderly, and so on, the nursing policy of the elderly in Japan has been continuously improved.Even so, social problems caused by Japan's aging problem continue to emerge in endlessly. For this reason, Japan has reformed its traditional social security system.The Insurance Law was promulgated in 2000 and has been continuously reformed and perfected since its promulgation, which makes the social security system for the elderly in Japan develop in the direction of complementary economic support and service security.This article mainly through the related policy, the legal system inspection and the domestic and foreign scholar books, the article research, in Japan introduces the insurance legal system research foundation, to this legal system formation background, the operation pattern,Through the analysis of the reform and development, the author summarizes the characteristics and feasibility of the system, thus providing an enlightening reference for the design of the long-term nursing insurance system for the elderly in China.
