【摘要】：人口老龄化的浪潮已经遍布世界各地,除了中东的少部分地区和非洲以外,世界一半以上的国家和地区都在一样的挑战着人口老龄化引发的社会动汤趋势和巨大风险压力,伴随一起的还有强大的社会经济重担和政治方面的压力,如何解决好人口快速老龄化这一世界性问题已经成为每个国家和地区最为关心的时代难题。老龄化社会开始于20世纪,时至今日我们国家老龄人口数量有增无减,老龄人口的规模加速壮大,高龄老人、空巢老人和失能老人数量日渐增长的现状尤为突出,对我国传统养老体制和现在的老年人社会保障体制产生了巨大的冲击。引人注意的是,由于城乡二元经济结构等原因,导致农村老龄化问题被人们所忽略,从而形成了我国独具特色的老年人养老制度二元化格局。农村老年人目前的生活现状应该引起政府、社会和家庭的关注,这就需要加强法律制度建设,让制度先行,为维护他们的权益提供强有力的保证,助推构建和谐社会的进程。本文将对农村老年人在法律保护过程中出现的问题进行客观分析,找出原因,另外借鉴参考其他国家在保护老年人权益中的一些好的经验和做法,在此基础上,提出进一步完善我国农村老年人在权益保护立法方面和在实践中具有可操作性的建议。
[Abstract]:The tide of population aging has spread all over the world. With the exception of a few parts of the Middle East and Africa, more than half of the world's countries and regions are equally challenging the social trends and enormous risk pressures caused by population ageing. Accompanied by strong social and economic burdens and political pressure, how to solve the world problem of rapid aging of population has become the most concerned by every country and region. The aging society began in the 20th century. Today, the number of the elderly population in our country is increasing, and the size of the elderly population is growing rapidly. The increasing number of the elderly, the empty-nesters and the disabled are particularly prominent. It has a great impact on the traditional pension system and the current social security system for the elderly. Attention is drawn to the fact that due to the dual economic structure between urban and rural areas the problem of aging in rural areas has been neglected thus forming a dualistic pattern of the old-age pension system with its unique characteristics in our country. The current living situation of the elderly in rural areas should attract the attention of the government, society and family. It is necessary to strengthen the construction of the legal system, to give the system first, to provide a strong guarantee for the protection of their rights and interests, and to promote the process of building a harmonious society. This article will carry on the objective analysis to the countryside old person in the legal protection process question, finds out the reason, in addition draws lessons from other countries in the protection of the old people's rights and interests in some good experiences and practices, on this basis, Some suggestions are put forward to further improve the legislation and practice of rural elderly people's rights and interests protection.
